Thirty horses on way to slaughter die in New York trailer fire

(Reuters) - Thirty horses being taken to slaughter in Canada were burned alive when the tractor-trailer transporting them caught fire on an upstate New York highway, state police said on Tuesday. The horses were on their way to a rendering plant in Quebec on Monday evening when the incident occurred on Interstate 81 near the town of Lisle, about 55 miles south of Syracuse, police said.

Ontario unveils budget, opposition support not clear

TORONTO (Reuters) - Ontario's minority Liberal government unveiled a budget on Thursday that projected a narrower-than-expected 2013-14 deficit and included measures aimed at securing opposition support and preventing an early election for Premier Kathleen Wynne. However, it was not clear whether the budget will receive enough support to keep the Liberals in power, as opposition New Democratic Party leader Andrea Horwath said she would consult with voters before deciding what to.

Hawaii Fishermen's Alliance for Conservation and Tradition Inc., a coalition of fishing clubs and groups from across the islands, filed a petition to the National Oceanic and Atmospheric Administration last month.

There are more than 21,000 humpback whales in the North Pacific today, compared with about 1,400 in the mid-1960s.

More than half spend the winter breeding and calving in Hawaii's warm waters. The animals, known for acrobatic leaps and complex singing patterns, have become a major draw for tourists and support a thriving whale-watching industry in Hawaii. Other North Pacific humpbacks winter off Mexico, Central America, Japan and the Philippines.

In the summer, they migrate to feed on krill and fish in waters off Alaska, Canada and Russia.

The fishermen say they don't want whaling to resume and aren't asking to be allowed to hunt the whales. They're also not trying to make it easier for them to catch fish, as they say the law's protections for the whales don't interfere with fishing.

Instead, the fishermen are acting after watching environmental conservation groups petition to add many more species to the endangered list in recent years, like dozens of corals, seven different damselfish and a rare dolphin called a false killer whale, said Philip Fernandez, the coalition's president. The government should consider humpback whales for removal to maintain a balance, Fernandez said.

"You cannot add species after species after species without evaluating whether there are species that should come off," the West Hawaii fisherman told The Associated Press by telephone from Kailua-Kona on Hawaii's Big Island.

Fishermen are concerned the Endangered Species Act is being used as a tool to manage the oceans and this will ultimately affect how fishermen are allowed to fish, Fernandez said.

"The key thing is the ESA has turned into somewhat of a battleground," he said.

The commercial whaling ban and other regulations would continue to protect the whales even if they were to lose their endangered status, the petition said. Though some whales die each year after being hit by ships and getting accidentally caught in fishing gear, the petition argues these accidents haven't interfered with the overall population's growth.

The fishermen are asking NOAA to first declare the North Pacific whales a distinct population. If the agency does so, the coalition wants NOAA to then remove this population from the endangered list. Humpbacks are found around the world globally they number about 60,000 but the petition is seeking delisting for whales only in the North Pacific.

Angela Somma, NOAA Fisheries endangered species division chief, said the petition is the first seeking to delist humpback whales since the animals were classified as endangered in 1970.

The law gives the agency until mid-July to determine whether the petition merits consideration. If NOAA finds the petition has merit, the agency must come to a conclusion by mid-April.

NOAA last removed a species from the endangered list in 2008, when it determined the Caribbean monk seal had gone extinct. The last time a species' recovery prompted delisting was in 1994, when the agency removed the eastern North Pacific population of gray whales from the list.

NOAA also is considering delisting both the Hawaii population of green sea turtles and a population of Stellar sea lions that lives off the coast of California, Oregon, Washington and Alaska.

Miyoko Sakashita, a San Francisco-based attorney for the Center for Biological Diversity, said ship strikes and fishing gear entanglements still threaten humpbacks. Climate change and growing levels of carbon dioxide the ocean which is causing the oceans to become more acidic could harm the plankton that humpback whales depend on for food, she said.

"It could be an important success story for humpback whales, but NOAA should really proceed with caution because of the overarching threats to make sure the gains aren't unraveled," Sakashita said.

NOAA Fisheries independently launched a review of humpback whales in 2009 in response to data showing steady population growth. Somma said the agency is still working on this review.

Flakes of frozen ammonia coolant were spotted Thursday drifting from the long frame that holds the solar panels on the left side. Barely 48 hours later, ThomasMarshburn and Christopher Cassidy hunted in vain for the leak as they inspected and removed an old pump.

No new, major flaking occurred, to everyone's disappointment. NASA had ordered up the fast, impromptu spacewalk in hopes that ammonia flakes might lead the astronauts to the bedeviling hole or crack, which is too small to notice without a trail of icy evidence.

"All the pipes look shiny clean, no crud," Cassidy reported as he used a long, dentist-like mirror to peer into tight, deep openings.

"I can't give you any good data other than nominal, unfortunately. No smoking guns."

Despite the lack of visible damage, Mission Control ordered the spacewalkers to install a spare pump. The spacewalk was going to last no longer than the allotted six hours, the astronauts were advised.

The ammonia pump was the chief suspect going into Saturday's spacewalk, and the fact that nothing amiss was found meant that the problem, in all likelihood, was going to continue to vex NASA in the weeks ahead.

"There's nothing to lose" by putting in a fresh pump and pressing ahead with "additional detective work," Mission Control explained. "The mystery mounts."

NASA said the leak, while significant, poses no safety threat. But managers wanted to deal with the trouble now, while it's fresh and before Marshburn returns to Earth in just a few days.

The space agency had never before staged such a fast, impromptu spacewalk for a station crew. Even during the shuttle days, unplanned spacewalks were rare.

Flight controllers in Houston worked furiously to get ready for Saturday's operation, completing all the required preparation in under 48 hours. The astronauts trained for just such an emergency scenario before they rocketed into orbit; the repair job is among NASA's so-called Big 12.

This area on the space station is prone to leaks. The ammonia coursing through the plumbing is used to cool the space station's electronic equipment. There are eight of these power channels, and all seven others were operating normally. As a result, life for the six space station residents was pretty much unaffected, aside from the drama unfolding Saturday 255 miles above the planet.

The loss of another power channel, however, could threaten science experiments and backup equipment.

NASA's space station program manager Mike Suffredini said it's a mystery as to why the leak erupted. Possibilities include a micrometeorite strike or a leaky seal. Ammonia already had been seeping ever so slightly from the location, but it increased dramatically Thursday.

Marshburn has been on the space station since December and is set to return to Earth late Monday. Cassidy is a new arrival, on board for just 1 months.

"Suddenly very busy," Marshburn said via Twitter on Friday.

By coincidence, the two performed a spacewalk at this troublesome spot before, during a shuttle visit in 2009.

"This type of event is what the years of training were for," space station commander Chris Hadfield said in a tweet Friday. "A happy, busy crew, working hard, loving life in space."

NEW YORK (Reuters) - Author Michael Lewis did not defame a money manager in his best-selling 2010 book "The Big Short," according to a federal judge in Manhattan.

In a lawsuit filed in 2011, Wing Chau, a manager of collateralized debt obligations, and his firm Harding Advisory LLC, accused Lewis of including a series of defamatory statements in a chapter revolving around a 2007 dinner in Las Vegas that included Chau and hedge fund manager Steven Eisman.

The book, which spent six weeks atop The New York Times' list of hardcover nonfiction bestsellers, looks at the housing and credit bubble during the 2000s that lead to the 2007 financial crisis.

Chau also named Eisman and the book's publisher W.W. Norton & Co as defendants, over what he called "accusations of grave professional misconduct, incompetence, and irresponsibility."

But U.S. District Judge George Daniels said the statements were "non-actionable expressions of opinion," not "assertions of fact that may properly serve as a basis for libel claims."

"A careful review of Chapter 6 of The Big Short indicates that the challenged statements are incapable of being reasonably susceptible to any defamatory meaning," Daniels wrote in a ruling on Friday.

Moreover, Daniels said "many of the allegedly defamatory statements about the plaintiffs are completely or substantially true."

"We respectfully disagree with the court's decision and intend to appeal," said Steven Molo, a lawyer for Chau.

W.W. Norton and a lawyer representing the firm and Lewis did not immediately respond to requests for comment.

David Schulz, a lawyer for Eisman, declined to comment.

The case is Chau et al v. Lewis et al, U.S. District Court, Southern District of New York, No. 11-01333.

CHICAGO (Reuters) - For years, headlines about Catholic schools in the United States have told gloomy tales of falling enrollment and multiple closings.

Between 2000 and 2013, 2,090 U.S. Catholic schools closed or consolidated and enrollment fell 24.5 percent, according to the National Catholic Educational Association (NCEA). In places like Chicago's Leo Catholic High School for boys, student numbers have plummeted from 1,200 students in the 1950s to 157 this year. In New York, the Catholic Archdiocese plans to close 24 schools.

This decline has implications for public schools throughout the nation, say Catholic school supporters. According to the NCEA, the 2 million U.S. students they serve save the nation approximately $21 billion a year in public school costs.

But while schools are closing in northeastern and Great Lakes cities, they're expanding in places like Indiana, Texas, North Carolina and Florida, which have growing Catholic populations, governments willing to support private school, or both.

In Raleigh, North Carolina, for example, Cardinal Gibbons High School has expanded three times since 1994 and now has two facilities for 1,240 students.

"Enrollment in this area is very, very strong," said diocesan superintendent Michael Fedewa. When he came to Raleigh 19 years ago there were so few Catholics it was considered "missionary territory." The diocese has since opened eight new schools.

Nationally, 32 percent of Catholic schools have waiting lists, showing the mismatch between space and demand.

LOSS OF CHEAP LABOR FORCE

Catholic schools took root in the United States when 19th century church officials, responding to anti-Catholic sentiment in public schools, urged every parish to build its own school. Enrollments peaked in the early 1960s, when there were more than 5.2 million students.

Staffed by religious orders like the Jesuits, the schools gained reputations for discipline and academic rigor. Catholic schools outscore public schools in reading and math significantly, according to the National Assessment of Educational Progress. For eighth-grade reading, for example, Catholic school scores were 7.2 percent higher, the NAEP found.

Graduates joke about getting smacked by nuns but brag about their education. "In my time as an editor, I could always pick out which reporters went to Catholic school, because they could spell," said Leo President Dan McGrath, a former Chicago Tribune editor.

Reasons for declining enrollment include climbing costs and demographic changes - smaller families and the departure of parents with children from northeastern and Great Lakes cities for the suburbs or for jobs in the south and west, according to Catholic school experts. The clergy sex-abuse scandal hasn't helped either.

The expansion of charter schools, which offer an alternative to traditional public schools and charge no tuition, have also hurt Catholic schools. About one in three students gained by charter schools in New York State came at the expense of Catholic schools, according to a new study by Abraham M. Lackman, scholar in residence at the Graduate School of Education, Fordham University.

Where Catholic schools are growing, it's often because of innovative ideas, voucher systems, and outreach programs for growing numbers of Hispanic immigrant children.

Money is a big problem. The number of religious sisters has declined from nearly 180,000 in 1965 to 54,000 in 2012, according to the Center for Applied Research in the Apostolate, or CARA. That has meant a large loss of cheap labor. Only 3.2 percent of the professionals at today's Catholic schools are clergy or in religious orders, compared with 90.1 percent in 1950, the NCEA said.

"They're replacing low-paid nuns with medium-paid lay people," said Charles Zech, an economics professor at Villanova University near Philadelphia and a specialist in church finances. Whereas lay teachers receive modest salaries, nuns receive "very small" annual stipends, room and board in the convent, and no pension, Zech explained.

Another issue is that Catholics on average give 1.2 percent of their income to the church, compared with 2.5 percent given by Protestants, Zech said. "At least since the mid-60s, we've seen a pattern of Catholics giving half of Protestants."

Weekly church attendance among Catholics fell from 47 percent in 1974 to 24 percent in 2012, according to the Pew Research Center. The clergy abuse scandal, which cost the U.S. church about $3 billion in settlements, and disagreement over the ban on contraception helped drive some people away, according to a Pew study. Less in the collection plate means less to subsidize school tuition.

Catholic school experts worry that soaring tuition is pricing out the low- and middle-income children the Church is supposed to serve. Sister Mary Paul McCaughey, school superintendent for the Chicago archdiocese, recalled how in the mid-1960s she apologized to her parents because her high school tuition rose to $470 (almost $3,000 in today's dollars).

Now tuition averages $3,673 a year for Catholic grade school and $9,622 for high school. The K-12 cost for private school averages $20,612, according to the National Association of Independent Schools. McCaughey said some families are afraid to even consider Catholic school, though scholarships are available.

School officials hope smart planning can save schools. In New York, the diocese is trying to improve its finances by closing underused schools, creating regional centers of control and bringing in help from lay experts for "our Achilles' heels" - marketing, finance and building management, said Timothy J. McNiff, school superintendent for the New York archdiocese.

Right-sizing has been painful. U.S. Supreme Court Justice Sonia Sotomayor told the New York Times she was "heartbroken" that her old Bronx grade school, Blessed Sacrament, would close. The Philadelphia archdiocese closed 34 schools last year.

The Chicago archdiocese will close five schools this year but has seen signs of a turnaround, with city elementary enrollment up three years in a row. McCaughey said young parents in gentrifying neighborhoods and a seven-day public school strike last fall are helping to boost the numbers.

LOOKING FOR TAX SUBSIDIES AND CHARITY

In Indiana, a voucher program for low- and middle-income students has been a boon for Catholic schools. In the archdiocese of Indianapolis alone, the number of voucher students more than doubled from 2012 to 2013, to 2,328.

"We've had to open up new classrooms," said Gina Fleming, assistant superintendent for schools. "We're finally able to provide a desired Catholic education to families who wanted it all along."

Teachers' unions oppose vouchers because they drain money from public schools, and such a program is unlikely in Democrat-majority states like New York and Illinois. Catholic school officials see more hope in programs that allow individuals and corporations to allocate part of their state taxes toward private-school scholarships. Fourteen such programs exist in 11 states, according to the National Conference of State Legislatures.

Catholic schools also are pushing for more private charity to help needy students.

"We try to turn nobody away for financial reasons. If they really want to come here, we try to find a way to make it work," said Leo's McGrath, whose desk is piled with letters to potential donors. One selling point: over the last five years, every Leo senior has graduated and gotten into college.

ATTRACTING HISPANICS

Many dioceses have seen an increase in the Catholic population due to Hispanic immigrants. But while Hispanics make up nearly 40 percent of U.S. Catholics, they account for just 14 percent of Catholic school students.

The problem is partly cultural. While U.S. Catholic schools have long taken children of various income levels, the schools are seen by many Latin American immigrants as only for the rich. So schools have to let Hispanic families know they're wanted, and explain that scholarships are available.

"You can't do that by giving them a pamphlet," said Raleigh's Fedewa. "You have to build relationships."

The diocese of Venice, Florida, worked directly with the pastor of a majority-Hispanic parish. He in turn reached out to 10 leading parish families to spread the word about Catholic school.

Bringing in Hispanics means being more culturally aware - from hanging images of Our Lady of Guadalupe, Mexico's famous icon, in the hall to having more chairs outside the office to accommodate extended families, said Kathleen Schwartz, diocesan education director.

The other way to expand Catholic schools is by offering innovative, competitive ideas, said Patricia Weitzel-O'Neill, head of the Roche Center for Catholic Education at Boston College.

She cited St. Jerome grade school in Hyattsville, Maryland, a school that's not in a wealthy area but is attracting parents willing to pay for a classical education that includes Latin and rhetoric.

Another example is Don Bosco Cristo Rey High School in Washington, D.C., where students work one day a week at a designated job partner. This helps teach real-world skills and pay for tuition.

Above all, according to Lorraine Ozar, director of the Center for Catholic School Effectiveness at Loyola University, schools must be true to their religious function: "to communicate the person of Jesus and the worldview that comes out of Gospel values ... We need that kind of school now even more than we did before."

NEW YORK (AP) -- He's rock royalty and likes to keep it old-school: Keith Richards says he doesn't own an iPod.

The Rolling Stones guitarist says he isn't a fan of the ultra-popular music device.

"I don't have an iPod. ... I still use CDs or records actually. Sometimes cassettes. It has much better sound; a much better sound than digital," he said in a recent interview.

The 69-year-old believes music lovers are "all being shortchanged" with the sound that comes out of an iPod, launched in 2001 by Apple Inc.

"My old lady's got one. My kids have got them. I say, 'Look me up this.' Or, 'Oh I like that. Check me that,'" he said. "I know what these things can do. I'm not totally anti-them."

The Rolling Stones' "50 & Counting Tour" kicks off Friday in Los Angeles. The Stones released their self-titled debut in 1964, and while Richards has accepted that the music industry is digitally driven today, he's not completely OK with it.

"They're sucked into it and they can't get out of it, nor can we; so is the public," he said. "There's something missing there, but it's the price of the future I guess."

Supreme Court President Alexis Dipanda Mouelle said Monday that Biya's Cameroon Peoples' Democratic Party scored 73 percent of the vote, winning seats in eight of the country's 10 administrative regions. The opposition Social Democratic Front received 17 percent, with 14 seats in just two regions. The opposition claimed vote-rigging but international observers said instances of vote-buying and intimidation were too few to change the overall outcome of the ballot.

According to the constitution, the 80-year-old Biya, in power since 1982, gets to appoint the remaining 30 members of the legislative body, ensuring total control of the newly-created 100-seat Senate.

Its creation was mandated by the 1996 constitution but was put off for 17 years, with the ruling party citing lack of funding and other reasons. The constitution stipulates that in the event of a vacancy at the helm of the state, the leader of the Senate will run the nation for a period of 40 days before new elections. The head of the Senate will be elected by majority vote during their first plenary session next month.

In recent years, Biya changed the constitution to allow himself to run for life. He most recently won re-election in a poll that was widely criticized in 2011, and has indicated that he plans to run again in 2018, when he'll be 86. It's raised fears of instability among the international investors who have flocked to Cameroon to get a piece of the country's petroleum riches. Neighboring nations where longtime rulers died in office have spiraled into violence, including in Guinea where the death of dictator Lansana Conte in 2008 was immediately followed by a military coup.

Critics say the new Senate simply perpetuates Biya's grip on power: His party already accounts for 153 of the 180 members in the National Assembly.

Observers from the African Union acknowledged that vote-buying had occurred, though they said that the instances did not impact the outcome of the April 14 poll.

"We think that on the whole, the elections unfolded hitch-free.Of course there were cases of vote-buying and intimidation, but these were too isolated to have an impact on the overall results," Edem Kodjo, head of an African Union observation mission, said soon after the poll.

Despite the limited representation by the opposition, the creation of the Senate was applauded as a step forward.

"We should be happy after 17 years of grumbling by the opposition, that the Senate is finally in place.It may be good or bad, but it is there and it is now left for us to work towards changing its make-up," said Jean De Dieu Momo, leader of the opposition Party for Democracy and Development of Cameroon.

Ni John Fru Ndi, leader of the Social Democratic Front and Biya's most significant rival, issued a statement saying: "Though the elections were choked with fraud ... setting up the Senate is a sign of progress for Cameroon's democracy."

Te'o was a notable absentee when the NFL's 32 teams made their first-round selections the previous night but he was the sixth man picked when the second of the seven rounds got underway in New York on Friday.

The Chargers, who have released a slew of veteran players, opening the way for the new crop to make their mark, traded up to get Te'o as the 38th overall pick.

They gave up a fourth-round pick to Arizona just to move up seven spots and ensure they got their man.

"That means a lot to me," Te'o said in an interview with chargers.com, the team's official website.

"Being a Charger means a lot to me right now. It's a great organization.

"I want to reward them for picking me. I'm going to do whatever it takes to help us win. "

When former Chargers defensive back Jim Hill announced that San Diego had taken Te'o, there was loud roar from the crowd inside Radio City Music Hall, where the draft was taking place.

Te'o, a 22-year-old linebacker who played his college football with Notre Dame, was not there, steering clear of the spotlight and opting to watch the national telecast instead from Hawaii, where he was born and raised.

An All-American player who finished runner-up in the Heisman Trophy, awarded to the best player in college football, Te'o's private life has superseded his sporting career.

He became a source of fascination for the American public when it was discovered earlier this year that he was the victim of an elaborate hoax about a fake girlfriend who supposedly died, but never really existed.

"It's definitely made me stronger," Te'o told the Chargers' website.

"Dealing with adversity, it can hurt you or make you stronger, and it definitely made me stronger. That's how I feel right now."

Heavily scrutinised then widely ridiculed, Te'o's hopes of being selected in the first round draft began to fade as the story gathered momentum.

He did not play at his best in the national championship game against Alabama and questions about his ability to make it in the NFL were raised after he performed poorly at the NFL Combine, where prospective players show off their skills.

The teams considered most likely to select him in the first round went looking for other players, but he seemed a perfect fit for the Chargers, who play a defensive scheme similar to Notre Dame, that suits his skills.

"It's great motivation for me to go out there and just get better and that's what I intend to do," Te'o said.
