One storm-related death was reported in the Dominican Republic: a firefighter swept away by floodwaters.

What was once a fast-moving storm began degenerating late Wednesday afternoon about 230 miles (370 kilometers) east-southeast of the Jamaican capital of Kingston. Its remnants still packed maximum sustained winds of 45 mph (75 kph), but a reconnaissance plane found that Chantal lacked the closed circulation necessary to be classified as a storm.

The U.S. National Hurricane Center in Miami said the wave was expected to spread over Jamaica and eastern Cuba into Thursday. It was projected to move over or near the Florida peninsula by Friday, where heavy wind shear is expected to keep it from reforming as a storm.

Jamaica's Meteorological Service said "the main threat at this time is for outbreaks of heavy showers and thunderstorms," starting over eastern parishes. It warned that flash flooding was possible and called for mariners to stay alert.

As a storm earlier Wednesday, Chantal's center skirted the southern coasts of the Dominican Republic and Haiti, which share the island of Hispaniola. But its heavy rains still posed a threat to some of the region's most vulnerable people, many of whom live in flimsy homes of plywood and corrugated steel.

The only reported fatality was that of Juan Ramon Rodriguez, a 26-year-old Dominican firefighter, in the community of Maimon, about 50 miles (85 kilometers) north of the capital of Santo Domingo. Rodriguez was trying to clear a storm drain when rushing waters carried him away, said Luis Luna, director of the country's civil defense agency.

Dominican authorities were evacuating thousands of people from communities considered at high risk for flooding as rivers near the capital and along the southern coast reached dangerously high levels from the heavy rains. Authorities said more than 6,500 people had been evacuated by Wednesday night.

"We're not in the clear yet," said Juan Manuel Mendez, director of the Emergency Operations Center.

Even remnants of Chantal could create problems for the rural southern peninsula of Haiti and southwestern Dominican Republic. Tropical systems can trigger flooding and landslides on Hispaniola, and severe deforestation and makeshift housing make Haiti especially vulnerable.

Haitian officials urged people to move away from ravines, secure important records and stock up on food and water.

Farmers in southern Haiti, where mountainside crops are particularly vulnerable to strong winds, feared the worst as heavy rain fell. "I'm scared for the people," farmer Jean-Marc Tata said by telephone of his neighbors in Mapou, a village near the southeastern coast.

All tropical storm warnings were cancelled late Wednesday afternoon. But people in Jamaica, eastern Cuba and the Bahamas were urged to monitor the wave's progress.

American Airlines canceled flights to Haiti and elsewhere in the Caribbean, and cruise lines made numerous changes to their itineraries.

Chantal raced through the eastern Caribbean early Tuesday, with officials in Dominica reporting that heavy winds ripped the roofs off over 15 homes and toppled power lines. No injuries were reported there or anywhere else in the small islands of the Eastern Caribbean.

Overnight, the storm passed south of Puerto Rico, leaving about 7,000 people in the U.S. territory without power and more than 2,500 people without water. Gov. Alejandro Garcia Padilla ordered public employees back to work on Wednesday.

In northeast Jamaica, Fredericus Enneking took it easy as gray clouds began swirling overhead and the breeze picked up at his eco-resort on a one-acre seaside property.

"You can feel something is in the air," said the Holland-born Enneking, who uses the Rastafarian name of "Free-I." Of course, you can never know what Mother Nature will do, but I am waiting for the storms later in the season. They are typically the ones that do the damage."

The U.S. International Trade Commission, which hears a long list of high-tech patent complaints, said in May 2012 that Google's Motorola Mobility infringed a Microsoft patent for generating and synchronizing calendar items. It barred any infringing Motorola Mobility device from being imported into the United States.

All phones with Google's Android software are affected by the ban, Microsoft said. But Google said that it should have applied to only some Motorola Mobility Android phones.

That order was to have gone into effect 60 days after it was issued but, according to Microsoft's court filing, it still has not been enforced.

"CBP (Customs and Bureau Protection) has repeatedly allowed Motorola to evade that order based on secret presentations that CBP has refused to share with Microsoft," the complaint said.

Google argued that Microsoft tried to broaden the order beyond what the ITC had intended.

"U.S. Customs appropriately rejected Microsoft's effort to broaden its patent claims to block Americans from using a wide range of legitimate calendar functions, like scheduling meetings, on their mobile phones," said Matt Kallman, a Google spokesman.

A spokeswoman for U.S. Customs declined comment.

The filing is the latest salvo in an international smartphone patent war that has embroiled a half dozen companies in lawsuits filed in about a dozen countries.

The dispute is a sign that deciding which product infringes a patent is harder now that the world has gone high tech, and that Customs may not have the needed expertise to make that determination and perhaps should rely on the ITC, said Deanna Tanner Okun, a former ITC chairman who is a partner at Adduci, Mastriani & Schaumberg, LLP.

"Problems have increased. The system is outdated," she said. "They're using practices and procedures that are 20 years old."

Tim Lincecum tossed aside his recent struggles and pitched his first career no-hitter and the second in the majors in 11 days, a gem saved by a spectacular diving catch by right fielder Hunter Pence in the San Francisco Giants' 9-0 win over last-place San Diego on Saturday night.

Lincecum has won two Cy Young Awards and two World Series rings. Now he has something really remarkable a no-hitter in which he threw a whopping career-high 148 pitches.

"Right now I think I'm just kind of coming down and don't know where to be emotionally," a calm Lincecum said.

The slightly built right-hander was in control from his first pitch until his last, which settled into left fielder Gregor Blanco's glove and set off a wild celebration in front of a pro-Giants crowd at Petco Park.

Catcher Buster Posey wrapped Lincecum (5-9) in a bear hug and lifted him off the ground. Lincecum was then mobbed by his teammates behind the mound and doused with water.

Blanco, who caught Yonder Alonso's fly ball to end the game, found Lincecum in the mob and handed him the ball.

Lincecum, who witnessed Jonathan Sanchez's no-hitter against San Diego in 2009 and Matt Cain's perfect game last year, was given a champagne shower by his teammates in the clubhouse.

"It's pretty surreal for me just to be part of that," Lincecum said. "Obviously I got to see a couple with Jonathan's and Cain's perfect game, but to be in the middle of it is a little different. I think I'm still kind of pinching myself right now."

Lincecum struck out 13. He walked four and hit a batter.

Still, he needed some help to preserve his no-no. Pence caught Alexi Amarista's sinking liner with a full dive to end the eighth. Lincecum pumped his fist as Pence excitedly jumped up and with the ball in his glove. Amarista put his hands to his helmet and pulled it off in disgust.

"That was really special. To be honest with you, I thought that was a hit off the bat by Amarista," Lincecum said. "But Hunter comes flying out of nowhere and makes the Superman catch. That was awesome."

Pence said he "just laid out and reached as far as I could and happened to just get there. I would say the whole game was one of the greatest feelings and greatest things to be a part of."

Said Amarista: "He got to the ball."

Lincecum's 148 pitches were the second most thrown in a no-hitter since at least 1988, according to STATS.

Edwin Jackson needed 149 pitches for his no-no for Arizona in 2010.

Lincecum had 103 going into the seventh and might've saved his shot at history with an 11-pitch inning.

"You don't see a pitcher up over 140 pitches in a no-hitter often," Posey said. "You get fatigued."

Posey noted that Lincecum threw more than 200 pitches all night, including 40 in the bullpen warming up pregame and then eight pitches before each inning.

"It takes a toll on your body, so for him to be able to continue to execute pitches is remarkable," the catcher said.

Manager Bruce Bochy said he had pitching coach Dave Righetti who threw a no-hitter for the New York Yankees on July 4, 1983 check on Lincecum the last few innings.

"I'm superstitious at that point," Bochy said. "I'm not going to say anything. There was no way he was coming out. I was just praying he didn't hit the 150 mark.

"He was just right on all night with all his pitches," Bochy said.

Lincecum was in a season-long funk. He was the loser when Cincinnati's Homer Bailey no-hit the Giants on July 2.

Pablo Sandoval did his part, too, when he made a nice backhanded play on pinch-hitter Jesus Guzman's grounder deep behind third base and threw him out for the third out of the seventh.

Lincecum had been struggling coming in, losing his previous four decisions and hadn't won since June 4 against Toronto. He hadn't won on the road since April 3 at the Los Angeles Dodgers. Then again, he'd gotten only 12 runs of support in his last 10 starts.

The crowd gave Lincecum a standing ovation as he headed to the mound for the ninth.

Lincecum struck out Chase Headley and then retired Carlos Quentin and Alonso on fly balls to left.

Lincecum tossed the 15th no-hitter in franchise history and seventh since the Giants moved to San Francisco after the 1957 season. Matt Cain was perfect last June.

The Padres remain the only team without a no-hitter.

Lincecum lost 15 games last year and ended the season as a reliever and a reliable one at that. He cut his hair short in the offseason, a new look as he started anew. He worked out with a personal trainer during the winter to add about 10 pounds of strength, and tweaked his mechanics.

Padres manager Bud Black said Lincecum was mixing his fastball, splitter, curve and cutter.

"He's evolved," Black said. "He knows how to pitch. He keeps his poise. He has us off-balance all night."

The Padres lost for the 18th time in 21 games and dropped a season-high 13 games under .500.

"We haven't been swinging the bats like we're capable," Black said. "We're not pitching. There's a lot of things we're not doing well. The last 2 weeks have been unacceptable. We just haven't gotten it done."

While Lincecum dominated the Padres, the Giants jumped all over San Diego's Edinson Volquez (6-8).

Posey and Sandoval had three hits apiece. Pence hit a three-run double and finished with four RBIs against Volquez, and then homered off Joe Thatcher leading off the eighth.

Brandon Belt hit a two-run home run an estimated 414 feet into the sandy play area beyond the fence in right-center in the fourth inning.

Volquez allowed eight runs and nine hits in five innings, struck out six and walked one. He threw 107 pitches.

NOTES: The four-game series concludes Sunday with a matchup of lefties. Barry Zito, who went to high school in San Diego, is scheduled to start for San Francisco and Eric Stults is scheduled to start for the Padres.

The well-known, well-financed and fierce social conservative said Sunday in San Antonio that he wants to succeed Gov. Rick Perry, who has announced he won't seek a fourth full term. Abbott has raised nearly $23 million.

Abbott has held office since 2002 and is popular among mainstream Republicans and tea party activists. Abbott has also sued the federal government on Texas' behalf 27 times during the Obama administration.

The only other announced candidate from either party is ex-state Republican Party chairman Tom Pauken.

No Democratic candidate has emerged, though some have urged state Sen. Wendy Davis to run. She became famous for her 12-plus-hour filibuster over sweeping new abortion limits during the Legislature's first special session.

Abortion debate flares in Chile over case of raped 11-year old.

SANTIAGO, Chile (AP) The case of a pregnant 11-year old girl who was raped in Chile by her mother's partner has set off a national debate about abortion in one of the most socially-conservative countries in Latin America.

Chileans were outraged on Friday after state TV reported that the girl is 14 weeks pregnant and was raped repeatedly over two years. Police in the remote southern city of Puerto Montt arrested her mother's partner, who confessed to abusing the fifth grader. The case was brought to their attention by the pregnant child's maternal grandmother.

Doctors say the girl's life and that of the fetus are at high risk. But in Chile, ending the pregnancy is not an option.

Chile allowed abortions for medical reasons until they were outlawed in 1989 under the dictatorship of Gen. Augusto Pinochet. The current government of conservative President Sebastian Pinera has opposed any loosening of the prohibition.

Many Chileans were venting outrage on social media Friday. Some started an online campaign to demand legalization of abortion in cases of rape or health risks for the mother.

"When I heard about this little girl my first reaction was to support abortion because I think it's the best option in this case," said Eduardo Hernandez, a 30-year-old web designer.

"It's the first online petition I've signed in my life, but I think this case really deserves it," Hernandez said. "We should have a law. I hope this case serves as precedent to have a serious discussion about abortion."

"We're faced with an 11-year-old girl whose childhood has been damaged and she's pregnant," Nicole Salvatierra, a 26-year-old-journalist, told The Associated Press in an email exchange after earlier speaking out about the case on Twitter. "The state is blocking a way to revert this situation. It's twice as bad for her. That's what's criminal, not interrupting the pregnancy in the context that justifies it."

But more conservative members of Chilean society oppose all abortions and the nation's Senate last year rejected three bills last year that would have eased the absolute ban.

"The Senate has voted in favor of life, of the unborn child, a policy the government has defended," Cristian Larroulet, a top presidential aide, said after one of the votes.

One of the bills would have permitted abortion if two doctors said it was needed because of risks to a mother's life or other medical reasons, such as a fetus with low chances of survival. Another one of the measures that was rejected would have allowed abortion in the event of rape.

Forty years after a brutal dictatorship, Chile remains firmly conservative in social matters. It legalized divorce in 2004, becoming one of the last nations in the world to grant married couples that right.

"Chile is a country that has modernized when it comes to its economy, but when it comes to its social and political culture, it has become stagnant and this is seen with the abortion issue," said Marta Lagos, head of the Santiago-based pollster Mori.

"It's a country that is adverse to change, that panics with any change, which is seen as a threat," Lagos said. "The weight of Catholicism is still a major issue and we also have a millenary indigenous culture that always lived alienated from the rest of world. We're part of that millenary culture of isolation."

The Roman Catholic Church retains a strong influence over society, although it has lost credibility since 2010, when four men alleged that they were abused by one of Chile's most revered priests when they were between 14 and 17 years old.

Pinera announced measures last year to combat child abuse, responding to a popular outcry over a spike in reports of these crimes. He toughened penalties on convicted pedophiles, increased the forensic institute's budget and created a children's ombudsman to protect their rights.

His center-right government also banned convicted pedophiles from working near children under a law that also requires those convicted of sexually abusing minors to be registered in a database. Reports of sexual abuse of children under the age of 14 rose by 22 percent in the first half of 2012.

But change comes slowly in Chile. An anti-discrimination law was stuck in Congress for seven years and only passed in 2012 after the killing of a gay man who was beaten by attackers who carved swastikas into his body.

"The Chilean elite is very conservative and this has had an influence in Congress," said Patricio Navia, a Chilean political scientist who teaches at New York University. "Laws, therefore, change at a much slower pace than the rest of Chilean society. Because society is much less conservative than it was 15 or 20 years ago."

Former president Michelle Bachelet, the frontrunner in the Nov. 17 presidential elections, favors legalizing abortion in cases of rape or risks to the health of the mother or the child. She spent the past several years heading the U.N. agency for women.

Her opponent, former Economy Minister Pablo Longueira, was close to Pinochet. He opposes abortion and the so-called day-after pill.

Daniel Alvarado, a prosecutor for the public ministry, told state TV that the case of the pregnant 11-year-old would be treated as a rape in any circumstance because at that age a person "doesn't have maturity to consent to a sexual relationship within law."

"It's not possible for any person at that age to have the capacity to understand the consequences on an act of that nature," Alvarado added.

In Latin America, only Cuba, Uruguay and some local governments make early abortions accessible to all women.

Uruguay recently passed a law authorizing elective abortions in the first three months of pregnancy in the most liberal law of its kind in Latin America. Passage of the law was widely seen as a landmark for a region in which many countries outlaw abortion in all circumstances.

The female goose initially was seen wandering in downtown Bay City in April and people alerted the state Department of Natural Resources, expressing concern for its safety, MLive.com reported (http://bit.ly/131InlA ).

Officials initially decided not to remove the arrow, because the bird was able to fly without difficulty. The DNR again came across the goose at the end of June when biologists were banding geese and decided to take action.

"It really, actually, was a lucky chance that we were able to get that goose in the pen when we were rounding up geese to band them," Michigan DNR Wildlife Outreach Technician Holly Vaughn said. "That particular goose wasn't targeted. It just happened to be with the rest of the geese when our biologists were banding."

A biologist removed the arrow, banded the bird and let it go within about a half-hour, releasing it back into the Saginaw River.

"The arrow was able to move freely within the bird. The wound from the arrow itself had pretty much healed up around the arrow," Vaughn said. "They found that taking the arrow out wouldn't do any further damage."

Officials say the goose appeared to be OK afterward, and Vaughn said it "just went on its merry way."

Tension soared when one of the animals charged a 31-year-old Spaniard, Diego Miralles, and tossed him on the ground with its horns for almost 30 seconds as fellow runners tried to pull it away by its tail. The man clung to one of the horns as screams were heard all around.

Helpers eventually dragged the victim to safety by his feet.

The regional government of Navarra said one American and two Spaniards were gored in the run, while another American and two Spaniards were also taken to city hospitals for other injuries suffered in falls and trampling during the frenzied event.

The University of Utah confirmed that the gored American was one of its students, Patrick Eccles. The local government press office gave his age as 20.

Navarra Hospital chief Javier Sesma said doctors removed Eccles' spleen after it was found that the bull's horn had gone through the abdominal cavity and punctured the non-vital, blood-filtering organ. He said the young man was in stable condition.

Sesma said the Spaniard who had been pinned to the ground was gored three times; in the groin, knee and thigh.

"The injuries are not as serious as one would have expected on seeing the televised footage," said Sesma.

None of the six taken to the hospital was said to be in serious condition.

Hospital authorities initially said four people were gored, but the regional government revised that down to three.

The gorings were the first of this year's runs, during which thousands of thrill-seekers race daily with the bulls along a 930-yard (850-meter) route from a holding pen to the city bull ring.

Friday's event lasted just under five minutes, roughly double the normal length. Longer runs normally occur when some of the bulls get separated from the pack and become disoriented and more dangerous.

The black bull that caused the most panic Friday made several more attempts to charge people before he was eventually guided along the narrow streets to join the rest of the pack in the pen of the packed bull ring.

The nationally televised 8 a.m. runs are the highlight of the nine-day street partying festival made world famous with the 1926 publication of Ernest Hemingway's novel "The Sun Also Rises."

The bulls that take part each morning are invariably killed by matadors in evening bull fights, and their meat is served up in Pamplona's restaurants.

Dozens of people are injured each year in the "encierros," as the runs are called in Spanish. Most get hurt after tripping and falling in the rush.

The fighting bulls used in the centuries-old fiesta can weigh up to at 1,380 pounds (625 kilograms) and have killed 15 people since record-keeping began in 1924.

NEW YORK (Reuters) - Faced with hundreds of damage claims it says are fictitious and inflated, BP must decide whether to dive into a protracted legal battle it had sought to avoid when it settled a class action over the 2010 Gulf of Mexico oil spill.

The British oil giant asked the Fifth U.S. Circuit of Appeals in New Orleans this week to halt the claims. Should its challenge before the three-judge panel fail, BP will face a choice: ask for a hearing by all the court's judges, appeal to the U.S. Supreme Court, or try picking off individual cases one by one, legal experts say.

BP declined to comment on what its strategy would be.

At issue is how to interpret a 1,000-page settlement document BP negotiated with a committee of lawyers working on behalf of thousands of individuals and businesses affected by the Deepwater Horizon rig explosion. The blast killed 11 men and dumped millions of barrels of oil into the Gulf in one of the country's worst environmental disasters.

BP estimated the settlement, approved by a U.S. District Court in Louisiana in 2012, would cost $7.8 billion, but the payouts may end up ballooning to billions more.

The company has already paid more than $2 billion toward the 198,021 claims filed under the agreement. Overall it says it handed out over $10 billion to those affected by the spill and around $14 billion in cleanup and response costs.

Several lawyers not involved in the case said BP should have known it might be on the hook for more money and erred by agreeing to a deal that had no payout cap.

BP said it stands by the settlement but insists the problem is the person appointed by the court to dole out the money, former Louisiana plaintiffs lawyer Patrick Juneau. The tussle is over how the administrator is calculating the amount of business losses due to the spill a claimant can be compensated for. BP takes issue with the time frame and the accounting methods Juneau is using.

Geoff Morrell, a BP spokesman, said Juneau's "misinterpretation" of the agreement "has ignited a feeding frenzy among trial lawyers attempting to secure money for themselves and their clients that neither deserves."

In a statement, Juneau said, "the proper place to address issues concerning the settlement agreement is in the courts."

U.S. District Judge Carl Barbier of New Orleans, who is overseeing the explosion of spill-related litigation, has repeatedly backed Juneau's interpretation.

So BP appealed to the higher court.

LEGAL OPTIONS

At times during the oral arguments on Monday, the Fifth Circuit judges threw tough comments at BP's lawyer Ted Olson, who served as U.S. solicitor general under President George W. Bush.

"The parties can't come in and change the agreement after it's been made," Judge James Dennis said.

There is no time limit for the Fifth Circuit to decide BP's appeal. If the three judges rule against BP, the company can ask for what is called an "en banc" hearing at the same court but in front of all the Fifth Circuit judges.

Fewer than 3 percent of en banc hearing requests are granted, according to the Fifth Circuit's website.

Also built into the settlement agreement itself is an internal appeal process that BP can use to challenge individual payments it believes were excessive and victims can use if they feel they were wrongly denied.

Internal appeal panels are chosen by Barbier from a list of nominees put forward by both sides. Thousands of appeals have already been filed this way. The process can be costly: There is a filing fee, and if the ruling goes against BP, the company is required to pay 5 percent over and above the original damage award.

If either side is not satisfied with the decision of the internal panel, they can ask Barbier to take up a discretionary review on a case-by-case basis.

Joseph Rice, a lawyer who spent a year and a half debating the settlement terms with BP on behalf of the plaintiffs, said BP has taken a handful of cases to this stage, but Barbier has not chosen to hear them yet.

If all else fails, of course, there is always the highest court in the land. That would be a long shot for BP.

Arthur Miller, an expert on civil litigation at New York University, doubts it will go that far, saying the Supreme Court prefers to hear cases that set legal precedent and are not focused on narrow contract questions. "This is a one-off situation."

Settling in the first place was meant to help BP avoid drawn-out litigation, like the 20-year legal brawl over the 1989 Exxon Valdez spill off Alaska. Claimants who opted in to BP's deal gave up their right to sue the company later.

The contested settlement replaced a process overseen by Kenneth Feinberg, an attorney who managed compensation for the victims of the September 11 attacks. Some plaintiffs were upset that damage awards under Feinberg were not flowing fast enough, and both sides agreed it would be better to settle.

Barbier is also overseeing a separate, multi-billion-dollar case to determine BP's federal pollution fines under the Clean Water Act, with potentially much higher liabilities. The second phase of that trial begins in September.

The U.S. Court of Appeals for the District of Columbia Circuit ruled that the IRS must treat foreign gamblers the same way it taxes U.S. bettors when they visit a casino.

"After a night of gambling, it's no fun to walk out of the casino a loser," wrote Judge Brett Kavanaugh for a unanimous three-judge panel. "But it's even worse when the IRS, on your way out, tries to tax you on each individual bet that you happened to win over the course of your losing night."

U.S. citizens are taxed on the gains they make per session. When a gambler cashes out at the end of the night, he or she owes income tax on any profits. If the session was unsuccessful, the bettor owes nothing.

That has not been the case with foreign gamblers, who were taxed on every winning bet made in games like slot machines regardless of whether they ended up losing money.

Sang Park, a South Korean businessman, visited the Pechanga Casino and Resort in California in 2006 and 2007. While he won more than $500,000 playing slot machines, he lost even more, leaving him with more than $50,000 in losses for those two years of gambling, according to court documents.

Nevertheless, the IRS taxed him on his winnings, claiming he owed more than $150,000 despite the fact that he lost money. Park filed a lawsuit challenging his tax bill.

The ruling overturned a decision from the U.S. Tax Court upholding the IRS policy.

A spokeswoman for the IRS declined to comment.

The tax agency had based its policy on the fact that foreigners cannot deduct gambling losses from their income, as U.S. residents can, and thus should not be allowed to do so during individual gambling sessions.

Kavanaugh, however, called that a "non sequitur."

"The fact that non-resident aliens may not deduct gambling losses from gambling winnings does not tell us how to measure those losses and winnings in the first place," he wrote.
