　　But those hoping for a mea culpa from Cupertino shouldn't hold their breath. Apple goes on to toot its own horn and highlight the parts of the judge's ruling that criticize Samsung's tablets - particularly that bit about how the Galaxy Tab lineup is "not as cool" as the iPad.

　　"The extreme simplicity of the Apple design is striking," the judge wrote. The Galaxy Tabs, though, "do not have the same understated and extreme simplicity which is possessed by the Apple design."

　　Apple concludes by pointing out that judges in Germany and the U.S. have ruled in Apple's favor on patent infringement cases involving Samsung.

　　Apple did not pen this note out the goodness of its heart, of course. In July, Judge Colin Birss of the High Court ordered Apple to post a note on its website and publish an ad in magazines and newspapers to say that Samsung did not rip off Apple when it designed its tablets. Not surprisingly, Apple was not pleased and appealed the decision, so its public apology was delayed. But the U.K.'s Court of Appeals last week upheld the lower court's decision. Apple has apparently decided not to take the issue to the U.K. Supreme Court, and posted the notice.

　　Once Sandy crosses Cuba it will parallel the East Coast and should affect the Bahamas as a strong hurricane. Florida, further away will feel tropical storm force strength wind from the storm. Basically, heavy rain, winds and a rough seas will be the rule for the next couple of days down there.

　　Hurricane Sandy will move north and eventually become what is called a hybrid storm. Storms that are tropical in origin are called tropical storms. Storms that originate in colder climates are called cold core storms. Tropical storms, as they move into colder water, often transition into a cold core storm. Sometimes, as will be the case with Sandy, the storm resembles bits of both types and we call this a hybrid. The semantics of what type of storm Sandy becomes when and if it impacts the Mid-Atlantic or New England region isn't important. Meteorologists will, if the storm becomes a blockbuster, debate what type of storm it was for years. We still debate the "perfect storm" from 1991 and whether that should have been named a hurricane. There is also the possibility Sandy remains purely tropical.

　　An advocacy group wants part of the Gila National Forest to be set aside for jaguars.

　　The Center for Biological Diversity said the endangered cat needs thousands of miles in Arizona and New Mexico to be reintroduced.

　　The U.S. Fish and Wildlife Service has already released a proposal for a jaguar habitat in New Mexico's Hidalgo County, but the environmental group said the jaguars would need more space.

　　Livestock owners oppose the habitat because they said it would impose unnecessary land restrictions on them.

　　As you'd imagine, the iPhone and iPad maker, which was awarded $1.05 billion by a San Jose jury as part of a sweeping legal win in August, isn't into a re-do.

　　In a 30-page filing tonight, the company attacked each of the claims made in Samsung's October 2 filing, saying the South Korean electronics giant "fails to meet the high bar to obtain judgment or new trial on any claim," later adding that any attack on the jury's findings "is clearly unfounded."

　　Chief among the issues brought up by Samsung in its earlier filing was the involvement of Velvin Hogan, the jury foreman who appeared in a number of media interviews following the trial and commented on what went on behind the scenes. Samsung said Hogan failed to bring up the fact that he had a legal spat with Seagate in 1993 (of which Samsung owns a piece), something Apple says Samsung missed its chance to bring up.

　　"If Samsung's recent acquisition of a 9.6 percent stake in Seagate were so important that bias toward Seagate could create bias against Samsung, it should have asked Mr. Hogan about Seagate," the filing reads. "Had Samsung done so, or ordered the bankruptcy file--the exact step it took only after it received the unfavorable jury verdict -- it could have discovered the Seagate complaint. By doing nothing, Samsung waived its objections."
