The legislation has been decades in the making, and is currently being considered by the House of Representatives, where it will likely face some opposition.

Nonetheless, many states are hoping it will pass, saying an Internet sales tax will allow them to bring in much-needed revenue.

The total estimates of how much money states can make by taxing purchases from outside their borders remains to be seen, and S&P said it "believes revenues would be unlikely to boost tax revenues significantly in the near term compared with the size of total state budgets."

S&P also said there will be no near-term credit implications.

But if the bill is delayed for several years and states do not pursue other revenue sources, there is a possibility state revenues will erode. That, in turn, would hurt their credit, the agency said.

Nearly six months after departing the State Department, Clinton finds herself in the middle of an early effort by both parties to prepare for her return to politics even as she keeps to a schedule of highly paid private speeches, work on her book and her family's global foundation.

Clinton has not said whether she'll seek the White House in 2016 but grassroots activists are already at work on a super political action committee called Ready for Hillary, which has rallied local supporters, started a fundraising campaign and rolled out prominent endorsements.

Republicans, meanwhile, vow to dissect her work during the Obama administration including last year's deadly assault on the U.S. diplomatic mission in Benghazi and use the former first lady as a fundraising tool.

The efforts to define Clinton, who carries the scars of being seen as an inevitable president during her 2008 campaign against Barack Obama, underscore her tricky balancing act.

If she acts too political, the strong approval ratings built up from her globe-trotting, above-the-fray role as secretary of state could suffer. If she allows the presidential talk to become too loud, she might get stuck with the inevitable nominee tag, making her vulnerable to a liberal upstart in a Democratic primary.

Yet if she avoids the limelight too much, she might create an opening for another Democrat to emerge or allow the steady criticism from Republicans for her tenure at State to sully her image.

Republicans are in the early stages of an effort to chip away at her record at the State Department. American Crossroads, the GOP group tied to Republican strategist Karl Rove, released a web video in May that suggested Clinton was less than truthful in the Benghazi case, an episode they noted happened "all under Hillary Clinton's watch." An independent review last year blamed the State Department for inadequate security but largely absolved Clinton of wrongdoing.

Separately, American Rising, a Republican super political action committee led by Matt Rhoades, who served as Republican Mitt Romney's campaign manager, created the Stop Hillary PAC and has been raising money off a potential Clinton campaign. One email request, from Ted Harvey, a Colorado state senator and co-founder of the group, warned that "massive forces are aligning to begin a coronation of 'President Hillary.'"

Republicans say they would be remiss to give Clinton the time to quietly build a campaign behind-the-scenes without scrutinizing her record.

"You have to play by the rules of the game. That's what was done to Mitt Romney and other candidates," said Danny Diaz, a former adviser to Romney's presidential campaign who is not involved with either group. "To operate under different sets of rules would be foolhardy."

Ready for Hillary, meanwhile, has no official ties to Clinton. But the group is encouraging her to run and laying the groundwork for a future campaign. Veterans of the Clinton White House like Craig T. Smith and Harold Ickes are advising the group, which is building a network of supporters online and holding local rallies outside Clinton speeches.

Ickes and former Rep. Ellen Tauscher, D-Calif., organized three finance briefings for donors and potential donors in New York in late June and the group will release its first fundraising report later this month, providing an early glimpse of its resources.

Some donors have privately expressed concern with the focus on Clinton so early, even while other Democrats like Vice President Joe Biden and Maryland Gov. Martin O'Malley are viewed as potential candidates. They said it could backfire and create an aura of inevitability for Clinton that hurt her last time. Smith said they were trying to address just the opposite.

"If it was inevitable there would be no need for us to do it at all," Smith said.

Yet some Democrats aren't sold on the proposition. While Smith said he would have received a "red light" if the Clintons didn't approve of the super PAC's role he said he hasn't heard anything negative their effort is just getting off the ground and viewed with hesitation by some donors.

"I'd be surprised if many national donors want to spend the cash on a new grassroots organizing effort geared toward 2016 when we just raised $1 billion to create the best ground campaign in history," said Wade Randlett, a major Obama donor based in California's Silicon Valley. He said the Obama campaign offshoot, Organizing for Action, has been able to keep party activists engaged.

Clinton's most ardent supporters, including her husband, caution that voters should not read too much into her activities. The former president said in May his wife was "having a little fun being a private citizen for the first time in 20 years" and said the constant speculation was "the worst expenditure of our time."

Still, Hillary Clinton has spent time making her positions known on issues dear to the Democratic base. Via her much-buzzed about Twitter handle, she issued joint statements with her husband on the Supreme Court's striking down of a key provision in the Voting Rights Act and its rulings in two cases pertaining to gay marriage.

While Republicans see Clinton as a major threat in 2016, GOP officials report there is little appetite among top party donors to commit resources to anti-Hillary efforts right now.

"There are more immediate targets," said Charlie Spies, who led fundraising efforts for a pro-Romney super PAC last year. "The most important thing Republicans can be focused on right now is keeping control of the House of Representatives in 2014. Once that is accomplished we can turn our sights to taking over the White House in 2016."

Governor Perry didnt say explicitly that he plans to run for president in 2016. But his remarks in San Antonio might as well have been his opening campaign speech. We heard about his humble origins in Paint Creek, Texas. We heard his case for the Texas economy during his 14 years as chief executive, including 1.6 million jobs created and seven balanced budgets.

And we heard a dig against the federal government, always a good move when youre running for the Republican presidential nomination.

Weve stood strong against unwise policies from Washington that would bust the bank, such as expansions of unemployment insurance and Medicaid, Perry said.

Perry also said he would truly miss serving in this capacity (emphasis added) a signal, perhaps, that he wasnt done serving, just getting ready to finish serving as governor of Texas.

Less than two hours after Perrys speech began, a press release went out from the website, RickPerry.org, touting his record as governor and linking to his speech and a transcript.

Other clues have emerged pointing to a likely do-over for Perry as a presidential candidate, following his less-than-impressive attempt in the 2012 cycle. For example, hes just rehired his former presidential campaign communications director, Mark Miner.

Not long after the 2012 election, Perry himself suggested that he would run again.

"It was an extraordinary experience I mean, one that I wouldn't trade," he told a Texas tea party group last December. "And looking back on it ... I would do it again."

Conventional wisdom holds that Perry is a longshot for the 2016 GOP nomination. The potential field is full of young talent, with people like Sen. Marco Rubio of Florida, Gov. Chris Christie of New Jersey, and Gov. Scott Walker of Wisconsin.

And Perry didnt exactly have a smooth ride last time. He entered the race late, and committed some of the most memorable gaffes in modern political history. During a televised debate, he couldnt remember the third government agency he planned to shut down. Oops, he said with a shrug and a smile. (He later remembered: It was the Department of Energy.)

Once, while in New Hampshire, Perry turned in a rather slap-happy campaign appearance, leading to speculation that he was on something. He insisted he wasnt, though after he dropped out of the race, former aides pointed to a back operation he had had in 2011, and the pain medication he was taking, as a reason for his less-than-optimal run.

Now, assuming he is planning another run, he is doing so with plenty of forethought, and time to build up a warchest, bone up on policy, and hope that most primary voters dont care that he was the guy who said oops on national TV during a presidential debate.

In his speech on Monday, Perry also hinted at an old controversy that reminded some conservatives during the 2012 campaign including many tea partyers that they dont really trust him.

I will always remember people like Heather Burcham, who touched my heart in the last few months that she had left before she succumbed to cervical cancer, Perry said.

Back in 2007, the year Ms. Burcham passed away, Perry ordered all sixth-grade girls to be vaccinated against the human papillomavirus, which is said to cause cervical cancer. After a conservative backlash, the order was never implemented, and Perry said he regretted issuing the mandate. But he defended his intention, to fight disease.

In touching on the issue Monday, perhaps Perry was trying to inoculate himself against it in a future campaign. But if the latest survey on 2016 by the Democratic-leaning(PPP) is to be believed, Perry has his work cut out, even in his home state. PPP found that Texass junior senator, Ted Cruz, is the top choice among the states Republican primary voters for the next GOP presidential nomination, with 27 percent.

Rick Perrys presidential aspirations appear to be dead in the Lone Star State, as only 18 percent of Texas Republicans wish for him to run, PPP said in its release on July 3.

ATLANTA (Reuters) - Twenty-one current and former employees of a nursing home for Alzheimer's patients in Georgia, including its owner, face a total of more than 70 criminal charges for allegedly abusing elderly patients, authorities said Tuesday.

The abuses included employees restraining patients with bed sheets and subjecting them to "inhumane and undignified conditions" at Alzheimer's Care of Commerce, about 60 miles north of Atlanta, according to a statement from the Georgia Bureau of Investigation.

"There were accounts of physical abuse, such as staff members striking patients and throwing water on them," the statement said.

"Experts say Alzheimer's patients are more vulnerable to abuse because they are often unable to defend themselves and because forgetfulness can make them less likely to report it.

In 2012, a Congressional report showed that patients suffer abuse or neglect in one in three nursing homes in the United States.

In a nationwide survey conducted in 2010, about 50 percent of nursing home staff surveyed admitted they had mistreated their older patients within the past year. Most of those instances included neglect of the patient.

Earlier this year, a circuit judge in West Virginia upheld a $91.5 million verdict against a nursing home in the death of an 87-year-old woman with Alzheimer's.

Accusations against employees at the Georgia nursing home included "double diapering" of patients, so that the staff would not have to change soiled diapers as often, authorities said.

Investigators also discovered that staff members at the facility had felony convictions on charges such as voluntary manslaughter and identify theft, according to the statement.

The owner, Donna Wright, is among those facing criminal charges, including cruelty to a person 65 years or older, abuse, neglect and financial exploitation, said John Heinen, a spokesman for the Georgia Bureau of Investigation.

By late Tuesday afternoon, 11 of the 21 suspects had been arrested, but Wright, the owner, was still at large, he said.

There were 27 patients at the nursing home on Tuesday when investigators arrived, and three were taken to a local hospital for medical treatment, he said.

The remaining patients will be moved from the home after consultation with family members, the spokesman said.

NAIROBI (Reuters) - Kenyan shares rose on Thursday as bargain hunters picked up stocks cheaply after a recent falls and in anticipation of good results from listed firms, while the shilling was steady.

The main NSE-20 share index added 0.2 percent to 4,574.10 points.

Kenyan shares slumped over 8 percent in June on the back of profit-taking, concerns over the end of the U.S. stimulus programme and uncertainty over a government plan to re-introduce capital gains tax.

The index is still up 11 percent this year.

"The upcoming (interim) earning season has drawn some speculation," said Faith Atiti, an analyst at NIC Securities.

Companies whose financial year ends in June will also attract buyers ahead of their results announcements, she said.

Shares in mobile phone service provider Safaricom gained 1.6 percent to 6.45 shillings, while the Co-operative Bank climbed 1.3 percent to 15.70 shillings.

In foreign exchange, the shilling closed at 86.20/30 per dollar, barely changed from Wednesday's close of 86.10/30.

Traders said they expected the shilling to remain under pressure from dollar demand by oil importers in the absence of matching supply before next week's central bank rate setting meeting.

The shilling fell 0.3 percent on Wednesday, weighed down by oil importers buying dollars in a market short of inflows from usual sectors such as tea, Kenya's top hard currency earner.

"The besieged shilling looks open to further losses if inflows do not come through, with market punditry staking out for the 86.50 mark this week," said Commercial Bank of Africa in a daily note.

In debt, the weighted average yield on the 91-day Treasury bill rose to 5.496 percent from 5.175 percent last week.

Bonds worth 3.6 billion shilling swere traded, up from 2.1 billion shillings on Wednesday.

SEOUL (Reuters) - Smartphone leader Samsung Electronics Co Ltd is set to report a record $8.9 billion quarterly profit on Friday, even as growth in sales of its blockbuster Galaxy series begins to wane and new rivals emerge to eat away at its market share.

The Galaxy S, powered by Google's free Android platform, propelled the South Korean firm into the top rank of smartphone makers in 2012, overtaking Apple Inc whose iPhone had set an industry standard five years earlier.

But the South Korean firm, which posted five consecutive record quarterly profits until the first quarter of 2013, now faces questions about how it will deal with narrowing margins as rivals flood the market with cheaper, simpler smartphones.

"Earnings could improve further from here as Samsung could cut prices of the S4 to boost overall shipments to a level that offsets any decrease in selling prices," said Brian Park, an analyst at Tong Yang Securities.

"But the bigger issue is that there's not much clarity about its future product lineups, and smartphones are increasingly commoditized ... It's inevitable that Samsung's stellar profit growth will come to an end and stagnate starting from next year."

Shares in the $185 billion company have dropped 15 percent since early June, hit by a series of brokerages downgrades. The share price reflects concerns about handset margins, with its mobile business generating 70 percent of the tech giant's total profit.

Its share price woes equate to a fall in market value of 33 trillion won ($29 billion), almost equal to the combined market capitalisation of Sony Corp and LG Electronics Inc.

To be sure, Samsung is by far the world's top smartphone maker with 33.1 percent of the market compared with Apple's 17.9 percent in the first quarter, according to research firm Strategy Analytics. Its rich product portfolio spans both the high and cheap-and-cheerful end of the market.

But competition is getting intense with Chinese manufacturers such as Huawei Technologies Co Ltd and ZTE Corp making ground in the popular mid- to low-end market, especially in China, the world's biggest mobile market.

Underscoring the growing focus on cheaper devices, Nokia Oyj, once the handset king, unveiled two stripped-down 3G phones this week. They allow access to popular applications such as Facebook and Twitter, and sell for just $68.

Mozilla also said this week that first smartphones running on open-source software Firefox will be available through Deutsche Telekom and Telefonica. Priced at less than $100, the models are manufactured by TCL Communication and ZTE and allow developers to easily create apps, as the software is based on HTML-5.

Samsung, due to release its April-June earnings guidance on Friday, likely increased quarterly operating profit to a record 10.16 trillion won ($8.9 billion), according to a survey of 43 analysts by Thomson Reuters I/B/E/S.

That would be up 57 percent from a year ago and 15 percent higher than the previous quarter, reflecting the launch of its flagship Galaxy S4 in late April.

But its earnings estimates have been cut by 3 percent over the past 30 days, and analysts are warning that the days of thumping record profits may be coming to an end.

Citi analyst Henry Kim estimates Samsung's telecom profit margin would decline by 4 percent next year and 3 percent the following year on high-end market saturation and increasing sales of cheaper phones.

Samsung is widely expected to have sold between 72 million and 75 million smartphones in the second quarter, including some 20 million Galaxy S4. That's only marginally better than first-quarter smartphone sales of 69.4 million.

Solid recovery in memory chip prices is likely to offset the easing pace of growth in telecoms business, analysts said.

Prices of dynamic random access memory (DRAM) chips, used mainly in computers, have jumped nearly 90 percent so far this year. NAND chips, which are used in mobile devices to store data, are also widely expected to be in short supply.

Samsung is the world's top maker of televisions, handsets and memory chips, competing with Sony and LG in televisions and with Toshiba Corp and SK Hynix in memory chips.

LONDON (Reuters) - Smartphone app developer Shazam has found an unlikely ally in the form of Carlos Slim, one of the world's richest men, who is investing $40 million to back the development of the start-up best known for helping music fans identify catchy songs.

The move is surprising for 73-year-old Slim, who built his company America Movil in a more staid sector, namely the highly regulated telecommunications and TV business in Latin America.

Before Shazam, Slim's only forays into Europe were to plough 4.8 billion euros ($6.1 billion) into stakes in Dutch operator KPN and Telekom Austria, on which he is nursing huge paper losses after their shares declined sharply in the past year.

Slim, ranked the world's top billionaire by Forbes magazine with a net worth of $73 billion, was brought in by one of Shazam's venture capital owners, Silicon Valley fund Kleiner Perkins Caufield & Byers.

British-based Shazam will use the funds to accelerate its expansion into television, where its recognition software can tune into an advertisement's soundtrack then link viewers directly to the brand's website.

It wants to establish the offer in Britain and the rest of Western Europe and Latin America.

"Within 18 months we expect TV will significantly outperform the music side (of the business) and that's part of this investment," Andrew Fisher, executive chairman of Shazam, said in an interview.

HUGE OPPORTUNITY

Blue-chip brands such as Unilever, Procter & Gamble and American Express are among the companies who have already used Shazam in advertising campaigns in North America, where the company generates tens of millions of dollars in revenue from the TV side, Fisher said.

Given that global TV advertising spending totaled $350 billion in 2012, according to researchers Nielsen, the scale of the opportunity for Shazam is huge, said Fisher, who hopes the TV business will help build the company into one suitable for a stock-market listing.

"That's our ambition, to list ... Certainly, two years' time is realistic," he said. The company's products are already used by 350 million people.

America Movil has also agreed to promote Shazam across the dozen or so markets it operates in Latin America. "Shazam is defining a new category of media engagement that combines the power of mobile with traditional broadcast media and advertising," Slim said in a statement.

Slim's investment takes the total backing that Shazam has secured since 2009 to $72 million.

The billionaire businessman's empire of phone, construction and banking companies often expands by buying stakes in small companies. Earlier this year, Ora.TV, a fledgling online digital television network funded by America Movil, bought TV production company Stick Figure Productions.

Separately, Slim's Grupo Financiero Inbursa, which runs an investment fund managing about 5.15 billion pesos ($394.1 million), has invested in companies from film financier Movie Risk to natural gas company Gas Natural Mexico. ($1 = 0.7792 euros)
