Team owner Roger Penske said he was "very happy with the outcome" following John Middlebrook's decision.

"All of us have lost points, six, eight, 10, 12 for certain infractions over the years," Penske said. "I don't think this is something we worry about. Obviously we don't worry about it. But from my perspective, the key thing is to have our people back at the race track, operating in full control. I think that's most important. If we're going to win, and be a leader and win a championship again, we've got plenty of time to do that."

NASCAR inspectors confiscated parts from the rear suspensions of the cars of defending champion Brad Keselowski and Joey Logano before the April 13 race at Texas. NASCAR alleged the parts were not approved, while Penske maintained the parts had been approved but the organization was applying them in a way that fell in a gray area of the rule book.

Penske still felt that way Tuesday: "I don't think we were confused. As we interpreted the rules, these are undefined areas."

"This sport has been built on innovation," he said. "All of us have tried to innovate in areas not defined in the rulebook. We were in that area."

NASCAR docked Keselowski and Logano 25 points each, and fined crew chiefs Paul Wolfe and Todd Gordon $100,000 each. NASCAR also suspended Wolfe, Gordon, competition director Travis Geisler, car chiefs Jerry Kelley and Raymond Fox and engineers Brian Wilson and Samuel Stanley for six races.

All suspensions were reduced to two points races, plus next week's All-Star race. They can return to work at Dover for the June 2 race. Penske did not immediately address how the organization would address the personnel issues at Darlington Raceway this weekend.

"The important thing is, this is over," Penske said. "This has been 2-3 weeks of constant questions, lots of emotions. I feel our bench is strong and people can fill in for the crew chiefs."

Middlebrook, a former General Motors executive who is paid $1 per year by NASCAR, heard two cases last year. He reduced similar penalties against Hendrick Motorsports crew chief Chad Knaus after the initial appeals board upheld his punishment.

He lifted the suspension and reinstated Jimmie Johnson's points, but left intact the $100,000 fine NASCAR levied against Knaus for altering sheet metal on the car before inspection at the season-opening Daytona 500. Middlebrook also upheld all penalties on Richard Childress Racing for modifications made to Paul Menard's frame rails.

Penske praised NASCAR's appeals process, and didn't mind the two phases. But it's becoming clear that those who run afoul of NASCAR have their best chance at redemption with Middlebrook: Since NASCAR began keeping records in 1999, the first-phase National Stock Car Racing Appeals Panel that Penske went before last week has upheld 106 of 150 appeals.

Still, he said the system is fair.

"I think the process is good. The panel is the first step and you don't go to the Supreme Court the first day," Penske said. "We operated within the guidelines and I'm happy with the outcome."

During the first phase of appeal, each side presents its case separately to a three-member panel that is chosen from a pool of 49 potential jurors. The other side is not in the room during the presentation.

During final appeal, each side presents its case separately and Middlebrook then brings both parties into the room to question them together. Penske said that was the first time his organization was able to hear from Sprint Cup Series director John Darby directly about the infractions.

"Today we had the opportunity to meet with the chief appellate officer and we had that opportunity in conjunction to meet with NASCAR, and this was the first opportunity we had to listen to John specifically to say 'These are the areas we think you are over the line on,'" Penske said. "Obviously we had our rebuttal on that, and then the appellate officer had a chance to take into consideration all of the comments we made and NASCAR made, and he came up with a final ruling."

It's a busy week for NASCAR, which on Wednesday defends before the three-member panel penalties levied against Joe Gibbs Racing for an illegal part being found in Matt Kenseth's race-winning engine from Kansas.

JGR is not arguing the part was illegal. The team is instead seeking a reduction of the penalties because the infraction was a mistake on manufacturer Toyota's part that the team had nothing to do with, and it did not provide a competitive advantage.

SAN FRANCISCO (Reuters) - Google Inc Executive Chairman Eric Schmidt predicted on Tuesday that there will be more than a billion smartphones in use featuring its Android software within the next six to nine months.

Schmidt also noted that Google had no intention of blocking access to a new app from Facebook Inc, saying he was "phenomenally happy" with the app from Google's rival, which replaces the homescreen on Android phones.

The new Facebook Home app was released on Friday and gives the social networking service prominent placement on Android phones.

Removing Facebook Home from Google's app store would be counter to Google's "public statements, our policies, our religion," Schmidt said at a conference in New York on Tuesday organized by the technology blog AllThingsD.

Because the Android software is open source, companies are free to tinker with it and customize it to their needs. Facebook's Home app prominently displays Facebook's newsfeed and messages on the homescreen, stealing the spotlight from Google's own services such as Web search and maps.

The five-year old Android software has been a huge hit for Google, giving the Internet search company a strong footing with consumers who increasingly access the Web from mobile phones rather than from PCs. Android is now the world's No.1 mobile phone software, with more than 750 million mobile devices featuring Android in use across the world.

At the current rate, Schmidt said that Google should cross the 1 billion mark within six to nine months and will be "nearing 2 billion in a year or two."

Schmidt also said the European Union antitrust regulators were not looking at Android issues and he noted that regulators could be done evaluating a proposal to settle an investigation of the company within the year.

"If that proceeds think it will be a pretty good outcome for everybody," Schmidt said.

The European Commission, which began investigating Google's business practices in 2010, said Google may have violated antitrust rules by pushing its own services over those of rivals, copying travel and restaurant reviews from competing sites without permission and restricting advertisers from moving to competing services.

The world's most popular search engine formally submitted a package of concessions to European regulators last week. Neither the Commission nor Google have given details of the proposals. But people familiar with the matter have told Reuters these could include Google labeling its own services to differentiate them from rivals', and also imposing fewer restrictions on advertisers.

(Reuters) - Fashion designer Lilly Pulitzer died on Sunday in Palm Beach, Florida, at age 81, her company said.

Pulitzer was known for her bright, cheerful print shift dresses that were popular with socialites and evoked a lifestyle of affluence in Florida and New York's Hamptons resorts.

Her company, named Lilly Pulitzer, also made children's wear, men's wear and household goods, often based on the same prints and bright colors.

"Early this morning, Lilly Pulitzer Rousseau passed away peacefully in Palm Beach, surrounded by family and loved ones," her company said in a statement posted on Facebook. "Lilly has been a true inspiration to us and we will miss her.

"Lilly was a true original who has brought together generations through her bright and happy mark on the world," the statement said.

It did not disclose a cause of death.

Pulitzer's designs were born when she was running a juice stand in Florida and had a sleeveless dress made from colorful printed cotton to hide the juice stains, according to the company website.

She had eloped at age 21 with publishing heir Peter Pulitzer and moved to Palm Beach, "in the shadow of Peter's citrus groves," from New York City, it said. The couple later divorced.

The classic shift dress gained international attention when first lady Jacqueline Kennedy, a former classmate of Pulitzer's, was photographed wearing one of her dresses on vacation, it said.

Her company declared bankruptcy in 1984 but was relaunched in 1992.

She and Pulitzer had three children, according to People magazine. Her second husband was hotelier Enrique Rousseau who died in 1993, according to People.

ASPEN, Colo. (AP) -- The image was chilling: Snowmobile rider Caleb Moore, launched over his handlebars on a backflip gone wrong, rolled down the landing hill with his 450-pound machine somersaulting behind him.

Run over by his sled, Moore lay on the snow for several minutes before being helped off the course. As of Wednesday, he was hospitalized in critical condition because of bleeding around his heart and a complication involving his brain.

Moore's was the worst accident at the Winter X Games, which wrapped up Sunday night after four days of competition, but it wasn't the only harrowing moment. The wipeouts included a runaway snowmobile that sent spectators scrambling.

Even the highlights were hardly tame. Snowboarding star Shaun White soared a competition record 24 feet into the air during the superpipe competition, and fellow boarder Elena Hight showed off a difficult trick called a"double alley-oop backside rodeo" that involved a couple of backflips and a 180-degree rotation. It had never been seen in a competition.

All that, plus Moore's crash, has some wondering whether dialing up the difficulty each year improves action sports or has simply made them too dangerous.

"Should we be asking these questions? We absolutely should be," said Dan Lebowitz, the executive director of Sport in Society at Northeastern University, which examines the role of sports to promote healthy development and social responsibility.

The people performing these superhuman feats "really are just human," he said. "How do we maintain safety in that progression when that progression sometimes pushes every envelope to some amazingly extreme point?"

Moore's injuries underscore the dangers at Winter X, which was filled with numerous cover-your-eyes crashes.

Halldor Helgason of Iceland over-rotated on a flip in the snowboard big air competition and had to be taken off on a sled with a concussion. Rose Battersby of New Zealand sustained a lumbar spine fracture in a wipeout during practice before the skiing slopestyle competition, which will be an Olympic sport next winter at the Sochi Games.

Then there was this: Summer X Games motocross champion turned snowmobile newcomer Jackson Strong tumbled off his machine during the best trick competition, the throttle sticking and the sled swerving toward fans as they scurried away. The machine came to a rest when it got tangled in some netting and no one was seriously hurt.

Such a scenario had already crossed the mind of Levi LaVallee, a snowmobiler who captured two gold medals only to be sidelined for the final two competitions after tearing a muscle in his back.

"I've always thought about, 'What happens if the thing tips over and the throttle sticks?'" LaVallee said. "It was good, though, because it showed that X Games has a good setup with the fencing."

Whether action sports are too dangerous is an issue that's been raised before.

When freestyle skier Sarah Burke died in a training accident a little more than a year ago in Park City, Utah, there were questions about the halfpipe. Before that, the sport was examined when snowboarder Kevin Pearce suffered a severe brain injury in a fall in the same pipe as Burke two years earlier. Pearce has recovered and served as an analyst at Winter X.

But in general, the athletes accept the risks and defend their disciplines.

"To lose Sarah was such a blow to this entire industry," said snowboarder Gretchen Bleiler, who didn't compete this year as she recovers from a serious eye injury she suffered in training. "This sport brings so much joy, happiness and balance to my life and that far outweighs what could happen. You can't ever live your life with what could happen."

In a statement, X Games officials said they've paid close attention to safety issues over the event's 18-year history: "We've worked closely with athletes, risk management specialists, sport organizers and event managers to present the best possible experience for athletes and spectators. Further measures are constantly being evaluated."

Athletes say they prepare as best they can by trying out new tricks into foam pits and air bags set up at the bottom of courses. But even all the caution in the world can't prevent the fact that sometimes well-practiced maneuvers can go wrong in the air.

"You don't want to live your life in fear because of a situation," LaVallee said. "Look, I'm driving down the road right now and the worst-case scenario is a car could swerve over into my lane and run over me there it is, end of the road.

"That's kind of the same thing we think when we're competing. Hopefully, the preparation and countless hours of training and practicing will prevent the worst-case scenario from happening."

Tucker Hibbert the Shaun White of snowmobiling after winning his sixth straight SnoCross title just hopes casual fans understand that what they see on television is not true snowmobiling.

"You're seeing the most extreme side of what we do," Hibbert said. "That's a lot different than what the average person does on a snowmobile."

Hibbert doesn't participate in events such as best trick because, "I just wasn't born with those skills. I sit back and watch those guys, enjoy what they do."

He paused.

"You just hate to see anyone crash, anyone get hurt," Hibbert said.

Moore was in the middle of an impressive run in the freestyle event when he caught the top of the hill that was serving as a landing area. He initially walked away with help and went to a hospital with a concussion.

Moore later developed bleeding around his heart and had surgery. His family said that Moore, of Krum, Texas, also had a complication involving his brain.

Colten Moore, Caleb's younger brother and defending champion in the event, separated his pelvis in a crash later that same night.

LaVallee is no stranger to horrific wipeouts.

While training for the "Red Bull: New Year. No Limits" daredevil series two years ago in Southern California, LaVallee lost control of his snowmobile high in the air and landed violently on his side, bouncing down the landing ramp. He broke ribs, cracked his pelvis, collapsed one lung and punctured the other.

But he returned the next year and jumped a record 412 feet, 6 inches.

"We're passionate about the sport that we're in," LaVallee said.

"Anyone who competes has that drive to succeed, to go bigger than the next person or be the first one to do it."

The mentality is similar throughout action sports, even if the bar keeps getting raised.

"There are going to be benchmarks set and people trying to exceed that benchmark," Lebowitz said. "That's just the essence of our society and our social culture."

Kent Hendrix woke up Tuesday to his teenage son pounding on his bedroom door and telling him somebody was being mugged in front of their house. The 47-year-old father of six rushed out the door and grabbed the weapon closest to him a 29-inch high carbon steel Samurai sword.

He came upon what he describes as a melee between a woman and a man. His son stayed inside to call 911 while he approached the man along with other neighbors who came to help. The martial arts instructor didn't hesitate in drawing the sword and yelling at him to get on the ground.

"His eyes got as big as saucers and he kind of gasped and jumped back," Hendrix said by phone Tuesday afternoon. "He's probably never had anyone draw a sword on him before."

The man ran down the street with the barefoot Hendrix and others in pursuit. Hendrix said he couldn't catch the man before he fled in his car, but he picked up ChapStick that the man dropped and memorized his license plate.

"I yelled at him, 'I've got your DNA and I've got your license plate: You are so done,'" Hendrix said.

The suspect, 37-year-old Grant Eggersten, turned himself in to police an hour later, said Unified Police Lt. Justin Hoyal. He was booked on charges of robbery, attempted burglary, trespassing and violation of a stalking injunction.

Hendrix, a pharmaceutical statistician, was one of several neighbors who came to the woman's aid after she began yelling for help, Hoyal said.

The incident began just after 7 a.m. when the 35-year-old woman came out of her front door, Hoyal said. Eggersten was hiding behind her carport and attacked her, knocking her to the ground, Hoyal said.

He took her keys and tried to open the door into her house, Hoyal said. That's when the woman ran down the street calling for help.

The woman did the right thing by fighting back and calling for help, Hoyal said. She suffered minor injuries.

Hendrix, a bishop in The Church of Jesus Christ of Latter-day Saints, said it was the first time in 30 years of practicing martial arts that he's used the sword. He didn't swing it at the man, only showing him he had it.

He said he's proud of his 14-year-old son for alerting him and quickly calling 911. He said the family is still abuzz about the events.

"That kind of thing doesn't happen every day," Hendrix said. "Our neighborhood is a pretty quiet place."

A fourth-degree black belt in the Kishindo form of martial arts, Hendrix owns a collection of swords and weapons that he trains with, said his wife, Suzanne Hendrix. He has trained with the sword he used Tuesday for 20 years and keeps it by his bed.

"Some people have bats they go to," said Hendrix. "I have my sword."
