Battaglin, who rides for Bardiani Valvole-CSF Inox, won in a time of 6 hours, 14 minutes, 19 seconds along the hilly 246-kilometre route from Policastro Bussentino to Serra San Bruno.

The 23-year-old rider beat fellow Italians Fabio Felline and Giovanni Visconti in a bunch sprint on rainy, cobbled streets to claim his first Grand Tour stage victory.

Overall favourite Bradley Wiggins slipped to sixth in the general standings, 34 seconds behind Paolini. Main rival Vincenzo Nibali moved up to fourth, 31 seconds off the pink jersey. Defending champion Ryder Hesjedal of Victoria moved into fifth overall after finishing eighth in Tuesday's stage.

Wednesday's fifth stage is a mainly flat, 199-kilometre leg from Cosenza to Matera.

The 2nd U.S. Circuit Court of Appeals in Manhattan ruled that Prince had sufficiently transformed 25 of 30 pictures taken by photographer Patrick Cariou and published in a 2000 book that Prince's art could be considered a "fair use" of Cariou's work. The appeals court sent five pictures back to a lower court judge to decide whether they violated copyrights.

Central to the case were pictures Cariou took during six years he lived with Rastafarians in Jamaica. Prince altered and incorporated several of the photographs in a series of paintings and collages titled "Canal Zone," exhibited in 2007 and 2008.

The 2nd Circuit ruling largely overturned a decision by U.S. District Judge Deborah A. Batts that had found in Cariou's favor. Batts had ordered all infringing copies of the photographs, including the paintings and unsold copies of "Canal Zone," turned over to Cariou, who could decide to destroy them if he wished. The appeals court noted that Cariou had said he would not destroy them.

The appeals court, in a majority decision written by Judge Barrington Parker, said Batts was incorrect to conclude that Prince's art needed to comment on Cariou's work to be considered different enough and "fair use," a legal term that describes the point at which art based on a copyrighted work is transformed enough that copyrights are not violated.

The decision said 25 of Prince's artworks "manifest an entirely different aesthetic" from Cariou's photographs.

"Where Cariou's serene and deliberately composed portraits and landscape photographs depict the natural beauty of Rastafarians and their surrounding environs," the decision said, "Prince's crude and jarring works, on the other hand, are hectic and provocative."

The 2nd Circuit noted that Cariou, who lives in Paris, has not aggressively marketed his photographs and had earned just over $8,000 in royalties from a book of the pictures, while some of Prince's "Canal Zone" artworks have sold for $2 million or more.

The court also noted that the invitation list for a dinner that was hosted in conjunction with the opening of the "Canal Zone" show included wealthy and famous people, such as Robert De Niro, Angelina Jolie and Brad Pitt, Jay-Z and Beyonce, artists Damien Hirst and Jeff Koons, New England Patriots quarterback Tom Brady and supermodel wife Gisele Bundchen, Vogue editor Anna Wintour and authors Jonathan Franzen and Candace Bushnell.

Prince sold eight artworks for $10.4 million at the gathering, the court said as it explained why his art would not damage the potential market for Cariou's photographs.

"Prince's audience is very different from Cariou's," the court said.

Attorney Dan Brooks, representing Cariou, said the ruling isn't the end but is "just one step in a long process."

He said the 2nd Circuit seemed to be saying "because one artist is not well known and hasn't been commercially successful, it's OK for another artist with impunity to just steal his stuff as long as he's famous and selling his art to rich people."

Brooks said the decision was at odds with "fair use" rulings by other federal appeals courts.

Attorney Josh Schiller, representing Prince, called the decision "great news" that was "important not just for Richard Prince but for all artists."

"It was not about money and wealth," Schiller said, adding that it protects the rights of those artists who specialize in transforming images into new works of art.

Judge J. Clifford Wallace wrote a separate decision that agreed in part and dissented in part with the majority opinion. In it, he said he believed all the paintings should have been returned to the lower court to decide if they infringed copyrights.

LONDON (Reuters) - Liverpool striker Luis Suarez was handed a 10-match suspension by the Football Association (FA) on Wednesday following his bite on Chelsea defender Branislav Ivanovic at the weekend.

Suarez accepted a charge of violent conduct after the incident in the 2-2 Premier League draw at Anfield on Sunday but disputed the FA view that it merited more than a three-game ban.

An Independent Regulatory Commission met in London on Wednesday to decide the Uruguayan international's fate and added seven games to the usual ban for violent conduct.

The suspension begins immediately, meaning Liverpool's leading scorer will miss his side's last four games of the season and the first six at the beginning of next term.

Liverpool, who expressed their shock at the Commission's decision, have until Friday (1100 GMT) to appeal.

"Both the club and player are shocked and disappointed at the severity of today's Independent Regulatory Commission decision," Liverpool managing director Ian Ayre said in a statement on the club's website (www.liverpoolfc.com).

"We await the written reasons tomorrow (Thursday) before making any further comment."

Suarez's bite on Ivanovic's arm at Anfield was missed by referee Kevin Friend but television replays showed him sinking his teeth into the Serbian.

WIDELY CONDEMNED

The 26-year-old Suarez, who was banned for biting an opponent while with Dutch club Ajax before joining Liverpool in 2011, apologized after the game and was fined a reported 200,000 pounds ($305,700) by the club.

However, he was widely condemned for his behavior with some reports suggesting he was in danger of being sacked by the club, although Liverpool said this week that they wanted the Uruguayan to see out his four-year contract.

The FA said a three-match ban was "clearly insufficient" for the serious nature of the offence.

There was widespread support for the length of the punishment imposed with former Liverpool player Graeme Souness telling Sky Sports News: "I think 10 games is about right.

"What he did on Sunday is something I've never seen in a game anywhere before."

Former Liverpool midfielder Jamie Redknapp agreed.

"I think you have to accept that the crime that he committed probably warranted a 10-game ban," he said.

"It was an awful act of brutality really what he did and now he won't play for such a long time - it's is going to hit him where it hurts because he wants to play football."

Professional Footballers' Association (PFA) chief executive Gordon Taylor said the length of the sanction sent out a "strong message" but that it was important that the player received counseling to make sure it did not happen again.

Not everyone backed the FA's decision.

"Players who break peoples' legs, who do horrible tackles, get a three-game ban," former Liverpool striker John Aldridge told Sky Sports News.

"It's inconsistent. For me, it's not right, it's over the top."

Controversy has followed Suarez since he joined Liverpool, with his antics often overshadowing his impact on the pitch.

He served an eight-match ban for racially abusing Manchester United's Patrice Evra last season and later angered United manager Alex Ferguson by failing to shake the French defender's hand before their league match in February last year.

He has also been regularly accused of diving to win penalties and free kicks, while in an FA Cup tie this season against minor league Mansfield Town he was again criticized for scoring a goal despite a blatant handball.

Until Manchester United forward Robin Van Persie's hat-trick against Aston Villa on Monday that secured the title, Suarez was leading scorer in the league with 23 goals and he is included on a six-player shortlist for PFA Player of the Year.

LAGOS, Nigeria (AP) -- The traffic is there, grinding life to a halt as the middle class pound out messages on BlackBerry mobile phones and worry about Facebook. The heat, the sweat and the daily tragedy of unclaimed bodies lying alongside roadways, passers-by hurrying past for fear of someone else's misfortune becoming entangled in their own.

This is modern life in Nigeria's largest city, Lagos, which becomes almost a character of its own in novelist Chimamanda Ngozi Adichie's new book, "Americanah." And within its pages, one catches self-acknowledged glimpses of the writer herself, who shot to fame with her previous love story set during Nigeria's civil war called "Half of a Yellow Sun."

As that book is being made into a movie, more international attention will focus on Adichie, part of a raft of new Nigerian writers finding acclaim after years of military-induced slumber in a nation with a rich literary history. Yet Adichie, like her new book's heroine, finds herself straddled between a life in the United States and one in Nigeria, where even seemingly innocuous comments on hair care and wigs can stir resentment.

"I'm writing about where I care about and I deeply, deeply care about Nigeria," Adichie told The Associated Press. "Nigeria is the country that most infuriates me and it is the country I love the most. I think when you're emotionally invested in a place as a storyteller, it becomes organic."

That sense of place runs throughout "Americanah," make sure to stress the fourth syllable, says the daughter of a university professor and a university registrar. It's a term people use to describe the accents carried by some of the Nigerians now returning in droves to the country after it embraced an uneasy democracy after years of military rule. While oil and gas money continues to flow and other business opportunities abound, the nation's universities now sit in shambles, graduating more unqualified students than can be offered jobs.

That intellectual dulling has been challenged by a host of new writers, many of whom like Adichie live almost double lives abroad.

"She is part of the pack of novelists who have, after what you might call the two decades of silence, who have helped to tell Nigerian stories to the whole world again," writer Tolu Ogunlesi said. "It was the dictatorships and all that's associated with them. ... The '80s and '90s were dark ages of sorts for Nigeria."

It's that period where "Americanah" finds its beginning. Though dismissing the idea of being a "dutiful daughter of literary conventions," Adichie's new novel takes root in the vagaries and murmured promises of a love story like much of her other work. It also focuses largely on the slim percentage of Nigerians able to afford diesel generators in a country largely without electricity and who look at the poor through the chilled air and tinted-glass windows of luxury SUVs.

Despite that, her writing hits a nerve with Nigerian readers who identify with the descriptions of church worship services focused on getting foreign visas and the nervous wives of rich men in a nation notorious for philandering. Adichie describes herself as looking "at the world through Nigerian eyes," but she doesn't hold back on criticizing its culture that fosters widespread government corruption. Or what she perceives as the excessive, neutered politeness of "political-correct language" in the U.S.

"Nigeria wasn't set up to succeed, but the extent of its failure is ours. It's our responsibility," she said. "This country is full of so many intelligent people, so much energy, so much potential, so why are we here?"

That kind of truth telling isn't exactly welcome, even in a democratic Nigeria. Speaking Saturday night at a book signing, Adichie drew laughter and a few nervous looks from organizers by describing President Goodluck Jonathan as "not a bad guy, he just seems like he's floundering and has no clue."

It also leads to comparisons some make between Adichie and late author Chinua Achebe, who died in March at age 82. Both come from the Igbo people of Nigeria's southeast and Achebe's own praise of Adichie graces the cover of her new novel in Nigeria. Adichie said the rise of new writers served as a testament to the power of Achebe's writings and the works of others.

"I think there's just this wonderful flowering that's happening," she said.

Even more controversial, it seems, have been Adichie's comments on natural hair in Nigeria, where many spend huge sums of money on straight-banged wigs and weaves known as Indian hair. An online commenter on Twitter asserted that Adichie, whose natural hair sits in buns atop her head, said that those wearing weaves were insecure, sparking controversy. Adichie herself ended up responding to the criticism and gave a recent audience advice on finding hair conditioners with no sulfates.

"It's only black women for whom an entire industry exists which is geared toward specifically making sure that the hair that grows on their head looks different," she said. "I want natural black hair to be an equally valid option, not something interesting, not something you do when you're a jazz musician, but something you can do when you're a lawyer in a fancy firm in New York City or if you're a politician in Abuja," Nigeria's capital.

That, however, still remains a challenge. Adichie acknowledged it herself by pausing, and then adding: "My mother doesn't like my hair like that. She is still praying."

LONDON (Reuters) - Robert Redford said on Wednesday that the future of London's Sundance film and music festival was by no means certain, as he launched the British version of an event that aims to boost interest in independent film.

Last year was the first time that the U.S. actor-director had ventured outside the United States with a version of the Sundance Film Festival, the world's leading independent film festival, that he set up in Park City, Utah, 35 years ago.

Redford said last year was "a toe-in-the-water experiment" and had been successful enough to repeat, with this year's line-up including the U.S. rock band the Eagles and the Canadian musician and performance artist Peaches.

But he was noncommittal on its future.

"It is hard to declare a length of commitment until you let it play out and see how it goes," Redford told a news conference before the festival at London's O2 venue from April 25-28.

Last year he told reporters that he hoped Sundance London would prove a success with audiences and allow him to expand the festival to other parts of the world as a counterweight to the Hollywood blockbusters that dominate cinemas globally.

When asked on Wednesday if he still planned to take Sundance to other countries, he replied with a curt "No".

Redford, 75, set up the Sundance Institute in 1981, which led to the film festival, to encourage emerging and aspiring filmmakers working outside Hollywood's major studios. But he said the sector continued its uphill battle.

"Independent film has always had to struggle for a place in the universe ... overall mostly due to the economy it is difficult," he said.

A slate of 119 films from 32 countries were shown at Sundance in January, and 21 U.S. and British films were selected for London as well as musical performances by Peaches and indie rock band British Sea Power. The Eagles are not performing.

This year's films include nine documentaries, which focus on a variety of themes ranging from a struggling British dairy farmer in "The Moo Man", the ill-fated 2008 K2 climb in "The Summit", and the "History of The Eagles Part One".

Others British premieres include Michael Winterbottom's "Look of Love", in which Steve Coogan plays porn king Paul Raymond; Lynn Shelton's comedy "Touchy Feely" about a massage therapist; and Barbara Kopple's documentary "Running From Crazy" about Mariel Hemingway.

Redford said he was particularly fond of documentaries and proud of the advances made in this genre in recent years, which he attributed to encouragement by the independent film sector.

"We kept pushing documentaries forward so that now in our festivals they take up pretty much the same space as others films do," he said.

Kimberly Blackwell, 44, director of theprogram at Duke Cancer Institute, made TIME'slist for her work to develop treatments for this deadly disease. Blackwell's research focuses on a highly aggressive form in which cells produce too much of the protein HER2, which accounts for about one in five breast cancers, according to the Mayo Clinic. Blackwell's treatment approach, known as a "smart bomb," consists of an anticancer toxin that contains an antibody that can recognize the tumor, so healthy cells are not affected meaningfewer side effects and better chances of survival. Film studio executive Sherry Lansing, who wrote the TIMEpiece about Blackwell, had a mother die of cancer. "The brilliant work of Kimberly and scientists like her gives us real hope that we may, at last, be turning the corner in the fight against cancer," Lansing wrote.

Three AIDS researchers Hannah Gay, Katherine Luzuriaga and Deborah Persaud earned kudos from TIMEfor . Gay, a pediatrician at the University of Mississippi; Luzuriaga, an immunologist at the University of Massachusetts; and Persaud, a virologist at Johns Hopkins Children's Center, gave an HIV-positive baby HIV antiviral drugs within hours of its birth. Two-and-a-half years later, the child appears HIV-free, and does not require medication. Although this result represents only a single case, it "gives us more ammunition in the fight against HIV and AIDS," Mark Dybul, director of the Global Fund to Fight AIDS, TB and Malaria, wrote in TIME. The treatment offers hope for preventing AIDS in newborns, and possibly even adults a recent study claims 14 other patients have been able to keep their HIV under control.

Space pioneers

in this year's list, as stories of private rocket launches and meteorite impacts dominated the headlines. SpaceX founder and CEO Elon Musk, 41, appears on one of seven separate TIME covers and is listed in the "titans" category. TIME's tribute by business magnate Richard Branson hails Musk's achievements in private spaceflight (which include two successful unmanned missions to the International Space Station with SpaceX's Dragon capsule and Falcon 9 rocket). Musk, who also founded the companies Paypal, Tesla Motors and SolarCity, also gets a nod for his work in developing clean, renewable energy.

NASA asteroid hunter , 70, made the list in Time's "pioneers" category. Yeomens finds and tracks near-Earth objects, and "is one of the reasons we can all sleep a little better at night," according to former astronaut Rusty Schweickart, who founded the asteroid-hunting B612 Foundation and wrote about Yeomans for Time. Yeomans leads a team at NASA's Jet Propulsion Laboratory (JPL) that uses data collected by telescopes around the world to predict the trajectory of space rocks that could pose a threat to Earth years or decades from now. This threat was brought home earlier this year by the meteor explosion over Chelyablinsk, Russia, on Feb. 15, and the unrelated flyby of Asteroid 2012 DA14. Someday a stray rock might warrant a deflection campaign to spare humanity from the same fate as the dinosaurs, Schweickart wrote. []

In light of the successful deployment of NASA's Mars rover Curiosity, TIME recognized the missions project managers Peter Theisinger and Richard Cook, of JPL. Theisinger, 67, and Cook, 47, orchestrated the harrowing task of sending an SUV-sized spacecraft to Mars and lowering it on cables to the Red Planet's surface, where it is currently exploring. Seven months after landing, the rover has already found , its primary mission goal. "We can't thank Pete, Richard and their team enough for getting [the rover] there safely, and we should continue to thank them for the wisdom and thrills the rover will bring us as it explores its new home," wrote Caltech space scientist and former JPL Director Ed Stone in TIME.
