The drug, Gilotrif, was approved along with a companion diagnostic kit that can help determine if a patient's lung cancer cells express the epidermal growth factor receptor (EGFR) gene mutation.

Non-small cell lung cancer (NSCLC) is the most common type of lung cancer and represents about 85 percent of all lung cancers. EGFR gene mutations are present in about 10 percent of NSCLC.

Lung cancer is the leading cause of cancer-related death among men and women, and according to the National Cancer Institute, an estimated 228,190 Americans will be diagnosed with, and 159,480 will die from, the disease this year.

The companion diagnostic kit, called therascreen EGFR RGQ PCR Kit, is made by Qiagen N.V..

SAN FRANCISCO (Reuters) - Zynga Inc's decision to bring in the head of Microsoft Corp's Xbox business to replace founder Mark Pincus is a bold stroke that was hailed on Wall Street, but it still leaves questions as to who is ultimately in charge at the troubled game-maker.

Don Mattrick was personally recruited by Pincus. But Pincus holds on to 61 percent of the voting rights due to a two-tiered stock structure and will remain Zynga's chairman and its chief product officer.

Mattrick, who is credited with building Microsoft's Xbox business into a gaming powerhouse, hesitated before agreeing to take the job, people with knowledge of the events said.

His doubts finally faded during a grueling bike ride through the Santa Cruz mountains one recent weekend, when Pincus opened up to Mattrick about how he had come to terms emotionally with relinquishing the reins at the company he founded in 2007.

While Wall Street cheered Mattrick's appointment, sending Zynga's shares up more than 10 percent and another 3 percent after hours, some analysts questioned whether the shake-up would change Zynga's performance in a significant way.

"Bringing in someone who has worked at a larger company to assist in management duties I think is a relief right now," said Richard Greenfield, an analyst at BTIG Research.

"But Pincus is still the chief product officer. So the question is, what's actually changed day to day in terms of making hit games?"

Mattrick will hold the final say in day-to-day matters, including green-lighting new games, people familiar with the situation said.

Zynga's business model, which relied heavily on selling virtual goods to gamers on Facebook Inc's platform, began to disintegrate in mid-2012 as users tired of Facebook games and shifted to playing on mobile devices.

Pincus, who has long wanted to turn the firm he named after his pet bulldog into a large Internet company, privately acknowledged in recent months that he has lacked the ability to manage such a company, said a person familiar with his thinking.

This spring, Bing Gordon, the Kleiner Perkins Caufield and Byers investor and an active member of its board, floated the idea of recruiting Mattrick, whom Gordon had known from their years together at game publisher Electronic Arts.

Pincus quickly agreed to help woo Mattrick, and the two had a series of meetings in California and Seattle.

In a statement issued Monday, Mattrick emphasized Pincus's role as a visionary and described their working relationship as that of partners.

"I joined Zynga because I believe that Mark's pioneering vision and mission to connect the world through games is just getting started," Mattrick said.

Pincus praised his successor without reservation.

"I've always said to Bing and our Board that, if I could find someone who could do a better job as our CEO, I'd do all I could to recruit and bring that person in," Pincus said in a statement. "I'm confident that Don is that leader."

STELLAR TRACK RECORD

News of Mattrick's appointment, reported first by AllThingsD, sent Zynga shares up more than 11 percent earlier in the day. The shares rose a further 3 percent to $3.17 when Zynga confirmed the appointment after the bell.

Over the past year, the company's value has fallen to just 25 percent of its $10 initial offering price in December 2011 as Pincus struggled keep his company out of free-fall despite multiple waves of layoffs.

Mattrick's new role leading a game maker that publishes social media-based titles and smartphone games will be a marked departure from the world of big-budget, packaged console games where he spent most of his career.

Mattrick headed successful franchises like "FIFA" in his 15 years at EA, where he first worked under Gordon before later supervising Gordon. He joined Microsoft in 2007.

Once there, Mattrick helped turn the Xbox business into a profitable venture after years of losses, eventually propelling it into the No.1 selling console in the United States.

MICROSOFT RESTRUCTURING

Mattrick's departure comes just as Microsoft gears up to launch the third version of its console, called the Xbox One. Unveiled in May and scheduled to hit stores later this year, the machine has already stirred controversy.

Gamers attacked the high price, Microsoft's plan to require an Internet connection at least once a day and attempts to limit the sharing of used games. Last month, Microsoft reversed its position on the Internet connection and said it would allow game sharing.

Mattrick was known to be very hard on his employees but still well-liked within the gaming division at Microsoft, said one former Xbox employee. Still, his power did not extend much beyond his own unit in a company that is still essentially driven by its two main businesses, Windows and Office, and that may have contributed to his desire to leave, observers said.

"He had a good sense of humor, a pretty compelling vision of gaming, and a hard-nosed business sense," said one former Xbox employee, who asked not to be named.

Mattrick had been rumored to be considering leaving for months. After EA's CEO stepped down in March, industry sources speculated he was in the running to lead the top games publisher, where he previously held numerous leadership roles.

Mattrick's departure takes place against the backdrop of a broader re-shaping of Microsoft.

Ballmer is expected to announce a broad restructuring in the next few weeks that moves the company closer to his previously stated vision of becoming a devices and services company - much like Apple - rather than primarily a software company. There has been talk that Ballmer will create a devices' unit, moving the Xbox, Surface tablets and possibly the phone unit into one business.

NEW YORK (Reuters) - Canadian Anthony Bennett, a power forward who played one year at University of Nevada, Las Vegas, leaped over a pair of touted centers to emerge as number one pick by the Cleveland Cavaliers at Thursday's NBA Draft.

While many draft analysts predicted Nerlens Noel of Kentucky or Ukrainian Alex Len of Maryland would go No. 1, the versatile, 6-foot-8 Bennett was the surprise top choice of a Cavs team that finished last season with a 24-58 record.

"I'm just as surprised as everybody else," Bennett, who averaged 16.1 points and 8.1 rebounds as a freshman at Las Vegas last season, told reporters at Barclays Center, home of the Brooklyn Nets.

"I heard everything was up for grabs. But I'm just real happy, glad that I have this opportunity, and I just got to thank God for everything."

Injuries to Noel (knee) and Len (foot) may have cooled the Cavs to those young big men, but Toronto native Bennett himself required shoulder surgery at the end of his college season and that did not deter the Cavaliers.

"It's just crazy. Made history," said an excited Bennett. "It's just like a long-time dream that I had since I first started playing basketball.

"It's just crazy."

Bennett may be a touch smaller than classic the NBA power forward size, but he is strong, has a wide wingspan and good finishing moves around the rim, along with an accurate jumper that allows him to work from the outside as well.

"I can contribute at the four, at the three," said the 20-year-old. "There's things I still need to work on, but I feel like I'm a great team mate, unselfish. I think I can fit in right away."

Bennett said he had no clue he was going number one overall.

"When they said my name, that's when I knew," he said. "I had no idea before."

Bennett will be joining compatriot Tristan Thompson on the Cavs, who took the Canadian forward with the fourth overall pick in the 2011 draft. Thompson averaged 11.7 points and 9.4 rebounds a game last season for Cleveland.

"He's just a great guy,' said Bennett. "He seems real cool. Both from the same area. I'm going to be seeing him a lot."

Bennett was the first UNLV player to be voted Mountain West Freshman of the Year in 13 seasons and earned first-team All-Mountain West honors after leading the Rebels in scoring, rebounding and three-point percentage.

The Canadian scored in double figures in his first 17 games as a collegian, racking up 12 double-doubles, and scored 20 or more points 13 times.

Bennett's coach, Dave Rice, gave a sterling recommendation of his young forward before the draft.

"There's not much that he can't do on a court," said Rice.

"He can score from the perimeter. He can score in the post. He's a fabulous rebounder. The only thing that he lacked coming in was just experience."

Bennett predicted Canadians could go back-to-back atop the NBA Draft with Andrew Wiggins looming as a dominant player at Kansas.

"Next year with Wiggins, hopefully he does well at Kansas," said Bennett. "I'm rooting for him. I'm pretty sure he'll get that No. 1 spot."

LOS ANGELES (TheWrap.com) - Don't worry about Paula Abdul; she's finding work. At least for one night.

Abdul, who exited Fox's "American Idol" and "The X Factor" amid shakeups to those show's judges' panels, has picked up a little temporary work via a one-night stand on yet another Fox competition series, "So You Think You Can Dance."

Abdul will guest-judge the series on Tuesday night, Fox said on Monday. Abdul will help critique the Top 18 finalists, a group that includes Jasmine Mason, Alan Bersten and Mariah Spears.(The latter, by the way, is not a human mash-up of former "American Idol" judge Mariah Carey and former "The X Factor" judge Britney Spears.)

Fox Sports personality Erin Andrews will also guest-judge the episode.

Warner was suspended last month for punching England batsman Joe Root in a Birmingham bar following a Champions Trophy match between the teams.

He was banned until the first Ashes test but was not named in the team for the match which started at Trent Bridge on Wednesday.

"David has trained hard and been very supportive of the team and his team mates during the past few weeks but his preparation for the first test was not ideal," national selector John Inverarity said.

"He is in need of match practice and runs in the longer format and the Australia A games in Zimbabwe and South Africa will provide him with the best possible opportunity."

Warner will return to England to join the Ashes squad when he has had enough match practice.

Steve Smith, who was named in the team for the first test after being called up from the A tour of England, will stay on with the Ashes squad for the full five-match series.

Although he stopped short of endorsing his Republican heir apparent, state Attorney General Greg Abbott, there was little debate that's who Perry was referring to when he repeated a famous quote from legendary University of Texas football coach Darrell Royal.

"You gotta dance with the one that brung ya," Perry quipped, just before announcing that he wouldn't seek to continue in the office.

Abbott is popular with both grassroots tea party activists and mainstream conservatives in the GOP-dominated state. He already has raised a whopping $18 million in campaign funds, even without officially announcing his candidacy.

Perry said for months that he and Abbott had an agreement not to run against each other for governor a pact Abbott never confirmed. Still, Mark P. Jones, a political science professor at Rice University in Houston, said Abbott did a masterful job biding his time so he could carry on Perry's conservative mantle without making it look like he pushed him aside.

"I think you can see this as a managed transition," Jones said, "but one that was done on Rick Perry's terms, not on anyone else's."

Abbott, who has used his post to sue the federal government more than 25 times since President Barack Obama took office, has kept a low profile in recent weeks while Perry, already the longest-serving governor in Texas history, made up his mind about his political future. And, he was purposely nowhere to be found Monday, when Perry formally eschewed a fourth re-election try in front of 200 relatives, friends, current and former staffers and supporters in San Antonio.

Abbott, now considered the overwhelming front-runner for the GOP gubernatorial nomination in primaries set for March, "will make his intentions clear in the coming weeks," spokesman Matt Hirsch said.

Despite holding his post since 2002 and positioning himself as Perry's likely successor, the 55-year-old Abbott is hardly a household name in Texas.

Abbott has used a wheelchair since he was 26, when a tree collapsed on him during a jog, leaving him paralyzed in both legs.

He has used the attorney general's office to constantly sue the Obama administration over everything from its signature health care reform law to environmental regulations to federal voting rules.

An avid defender of gun rights and fierce opponent of abortion, Abbott champions social conservative causes but also is seen as a strong fiscal conservative.

"He gets what he wants which is to be governor, but he was able to do it without alienating one of the most popular politicians in the history of the state," Jones said. "Now the pathway between him and the governorship is a clear shot. There's nothing standing in the way, and he created no ill will between himself and Perry."

That's important because Perry has been governor since George W. Bush left for the White House in December 2000 and has reshaped what was traditionally a weak office to wield unprecedented power. Perry's sheer longevity has helped him fill every major appointed office statewide with loyalists often even his donors and dictate the direction of the Republican party in one of the country's most-conservative states.

Perry didn't mention Abbott by name but told Monday's crowd: "After January 2015, new chapters will be written, new leaders will write them."

A Democrat hasn't won statewide office in Texas since 1994, and for a generation, the winner of the GOP primary has usually cruised to victory in the general election, no matter the race.

No Democrats have yet entered the gubernatorial field, though state Sen. Wendy Davis, who became a national sensation for staging a filibuster to temporarily block sweeping new limits on abortion, may run.

Gilberto Hinojosa, who chairs the Texas Democratic Party, said a race against Abbott will look very similar to how one against Perry would have.

"They both think the exact same way," Hinojosa said. "Philosophically, there's absolutely no difference between Rick Perry and Greg Abbott."

Hispanics have accounted for nearly 90 percent of Texas' population growth in recent years, meaning demographics may soon no longer be on Republicans' side but the shift almost certainly won't come in time to affect next year's elections.

That means Perry's decision breaks a logjam of top conservatives waiting to move up as he held the top spot so long.

At least six out of nine elected executive offices will change hands as Texans replace the governor, attorney general, comptroller and commissioners for land, agriculture and railroads. They'll also get a chance to choose another lieutenant governor, with three men running to replace David Dewhurst, who plans to seek re-election.

Meanwhile, Perry left the door open for another White House run after his 2011 presidential bid flamed out. The governor is perhaps best remembered nationally for infamously forgetting during a debate the third of three federal departments he had promised to shutter if elected and muttering sheepishly, "Oops."

He used his Monday address to promote his accomplishments as governor, including overseeing a booming state economy that created nearly a third of the country's new jobs on his watch. He also promised not to let his focus slip in his term's remaining months.

"I will actively lead this great state," Perry said, "And I'll also pray and work to determine my own future."

O'Bannon and his lawyers asked a federal court judge to turn their antitrust lawsuit into a class action, representing thousands of former and current college athletes. The lawsuit demands that the NCAA find a way to cut players in on the billions of dollars earned by college sports from live broadcasts, memorabilia sales, video games and in other areas.

U.S. District Court Judge Claudia Wilken didn't rule on either the merits of O'Bannon's case or his demands to turn the case into a class action. It could take weeks, even months, before Wilken rules.

Instead, she ordered O'Bannon's lawyers to revise the lawsuit to fix some legal technicalities, including explicating adding current players to the lawsuit. Lawyer Michael Hausfeld said he will file a new lawsuit that includes current players, but will seek to keep their names confidential.

"They are afraid of retaliation," Hausfeld told the court.

NCAA lawyer Greg Curtner is against certifying the lawsuit as a class action, arguing that the claims of thousands of collegiate athletes are too different to be treated the same. For instance, certain athletes bring in more revenue than others and have different legal claims at stake.

The NCAA argues that many of the athletes receive scholarships in exchange for playing sports and to pay student athletes would ruin amateur athletics. To pay athletes more than that would ruin collegiate sports, the NCAA argues.

The debate over compensating college players is almost as old as the NCAA, founded in 1906. Amateurs have been expected to compete for free and the love of sport or at least the cost of a scholarship and the pursuit of an education.

The NCAA is steadfast in its position that student-athletes are prohibited from receiving payment for participating in sports. It also says it has done nothing wrong in marketing itself for the benefit of its member schools and will continue to vigorously contest the lawsuits

But the NCAA's revenues have skyrocketed in recent years it recently signed a $10.8 billion, 14-year television deal for basketball and so have the demands of athletes to share in the money.

"I'm doing this for change," O'Bannon said outside court.

The star of the NCAA 1995 basketball champion UCLA Bruins traveled from his Las Vegas home to attend the hearing Thursday.

He said he first became aware that others were profiting from his image in 1995, when he visited a friend's house and was shown an avatar resembling O'Bannon playing for the 1995 Bruins in the game. Two years later, he filed a lawsuit that focused attention from lawmakers, college administrators and others on just how much money the NCAA and its member schools earn each year.

The schools argue that money-making sports like football and baseball help support sports such as volleyball and gymnastics with smaller fan bases.

That may be, O'Bannon said, but he still thinks student athletes who help generate the revenues are entitled to a cut.

"I believe the kids coming through the system can do better than I did," he said. "I never thought this lawsuit would get this big, but now that it has, I hope it forces big changes."

LOS ANGELES (TheWrap.com) - Ringo Starr is developing quite the second career as a literary mogul.

First came news that the former Beatle is releasing an interactive book of photos from his days with the iconic group.

And now he's planning a children's book based on his Beatles song "Octopus's Garden."

Simon & Schuster Children's Books said Tuesday that it will publish a picture book edition of the song from the 1969 Beatles album "Abbey Road." The book will include a CD featuring previously unreleased music from Starr and an audio reading of the story.

The "Octopus's Garden" book will be illustrated by Ben Cory, who also illustrated "Aliens Love Underpants."

"It gives me great pleasure to collaborate with Ben Cort and Simon & Schuster for the further adventures of Octopus's Garden," Starr said of the new endeavor. "Peace and Love, Ringo."

Starr wrote the song in 1968, while vacationing in Sardinia on Peter Sellers' yacht. (Starr and Sellers co-starred in the 1969 film "The Magic Christian.")

"It's an honor to publish such a music legend," Simon & Schuster Childrens' Books president, publisher Jon Anders said. "The pairing of Ringo's whimsical lyrics with Ben's charming illustrations is a perfect fit. We're happy to bring the magic of this song to a whole new generation of readers."

The "Octopus' Garden" book will be published in hardback edition October 24, with a paperback edition following the next year. The book will be published in North America in January 2014.

DES MOINES, Iowa (AP) -- The World Food Prize Foundation on Wednesday took the bold step of awarding this year's prize to three pioneers of plant biotechnology whose work brought the world genetically modified crops.

The private nonprofit foundation, which is in part funded by biotechnology companies, refused to shy away from the controversy surrounding genetically modified crops that organic food advocates say are harmful to people and the environment.

"If we were to be deterred by a controversy, that would diminish our prize," said the foundation's president, Kenneth Quinn, a retired U.S. diplomat.

This year's award goes to Marc Van Montagu, founder and chairman of the Institute of Plant Biotechnology Outreach at Ghent University in Belgium; Mary-Dell Chilton, founder and researcher at Syngenta Biotechnology; and Robert Fraley, chief technology officer at Monsanto.

Van Montagu and Chilton independently developed the technology in the 1980s to stably transfer foreign genes into plants, a discovery that set up a race to develop tools to genetically engineer plants. It allowed other scientists to incorporate genetic traits in plants to better withstand drought, extreme heat and to fight off pests and disease. Fraley was the first to successfully transfer immunity to specific bacteria into a plant.

Fraley genetically engineered the first herbicide-resistant soybean in 1996.

The foundation lists Monsanto and Syngenta Foundation among its annual donors, along with other agribusiness corporations such as DuPont Pioneer, Archer Daniels Midland Co. and Cargill.

The award drew immediate condemnation from opponents of corporate farming.

"We could not ask for a better poster child for what's wrong with the prize than the recipients of this year's World Food Prize," said Frank Cordaro, who organized an Occupy World Food Prize protest last year. "It's all part of the very same system of the corporate elite. The problem is not with the recipients, the problem is with the system that gives the 1 percent all the power and corporate agriculture is built on that system."

Genetically enhanced crops are grown on more than 420 million acres in nearly 30 countries by over 17 million farmers worldwide, the foundation said. More than 90 percent are small, resource-poor farmers in developing countries.

Many U.S. farmers credited genetic modifications in corn with saving last year's crop from all but total devastation as half of the nation endured the worst drought in 60 years. Modern corn plants are more stable and can withstand a wider variety of climate conditions because of genetically improved leaves, roots and reproductive capability.

Fraley said biotechnology will enable the farming industry to meet the needs of a growing global population.

"We know we need from a demand perspective to double food production around the world in the next 30 years," he said.

Some organic farmers warn that widespread planting of genetically modified crops could contaminate organic and traditional crops, destroying their value. Others are concerned about the uncharted long-term impact for those who eat products such as milk and beef from animals raised on genetically modified plants.

"GMO crops have led to the loss of food security worldwide and for small farmers, they have led to the development of factory farms and have destroyed biodiversity in food we do produce and consume," said David Goodner, a community organizer for Iowa Citizens for Community Improvement, an environmental and human rights activist group that opposes corporate farming. "The World Food Prize by selecting these people to honor shows that it cares more about corporate profits than it cares about truly feeding the world with healthy food."

Van Montagu said the food prize award should raise understanding of the safety of genetically modified crops.

"We just have to explain to society the science fact and that is not the slightest risk has been identified. These crops are as safe, if not safer, than food that comes from traditional agriculture," he said. "If somebody denies that we bluntly can say they are misinformed."

The World Food Prize was created in 1986 by Norman Borlaug, winner of the Nobel Peace Prize for his efforts to fight hunger. Borlaug was honored in 1970 for work that boosted agricultural production in what has become known as the "Green Revolution."

Recipients will receive the prize, which includes $250,000, at a ceremony in October at the Iowa Capitol in Des Moines attended by hundreds of scholars and agribusiness leaders from around the world.

The BBC said in February that members of Cupid's online dating services suspected fake "flirtatious" messages had been used to encourage free users to sign up for paid subscriptions.

Cupid, which operates the benaughty.com and flirt.com websites, on Monday said it is making changes to the structure and approach of its "motivation team" so that Cupid staff will be clearly identified when interacting with customers.

Shares in the company were up 6 percent at 77 pence at 0825 GMT (4.25 a.m. EDT) on Monday on the London Stock Exchange. They have lost roughly two-thirds of their value so far this year.

The conclusion of the review is also expected to help the company in the sale of its casual dating business. Cupid had said last month that it had received several interests from potential buyers for its casual dating sites.

"People who are potential buyers in the business, and who may have seen risks around the practices should be reassured. That means the businesses are easier to sell and may get a higher price depending on individual negotiations," Peel Hunt analyst Stephen Yau told Reuters.

Cupid markets to people of different age groups, cultures and social interests, from its mature relationship website loveagain.com to its cheeky girlsdateforfree.com.
