In a lawsuit filed with the Manhattan federal court on Thursday, BMI said it had proposed an increase in Pandora's fees "consistent with market rates to reflect the explosive growth of the Internet music streaming marketplace."

BMI collects license fees on behalf of over 600,000 affiliated songwriters, composers and music publishers and distributes them as royalties to those members whose works have been performed.

One of the main challenges facing the decade-old Pandora is the rising cost of licensing music, which grows as more people tune in. The company had about 70.8 million active listeners at the end of May.

On Tuesday, Pandora said it agreed to purchase KXMZ-FM, a Rapid City, South Dakota-area radio station.

Pandora hopes the radio station deal will allow it to pay lower rates similar to the ones paid by traditional broadcasters such as Clear Channel Communications Inc on their digital services, such as Clear Channel's iHeartRadio.

BMI said in the filing it expects Pandora to claim it is no different from commercial broadcast radio now that it owns a radio station.

BMI currently has agreements with Pandora's rivals Spotify and Music Choice, in which the rates and terms are "the same as, or higher than, BMI's proposal to Pandora," it said in the filing.

BMI did not disclose the proposed license fees in the court filing. It has requested the court to confirm as "reasonable" the rates and terms requested by BMI for using music in the BMI portfolio.

Meanwhile, BMI said it had negotiated an interim license fee to be paid by Pandora starting January 1 until such time the dispute is resolved.

"Disputes regarding the reasonableness of fees between BMI and music users are adjudicated in federal court ... we look forward to the court's oversight of this matter," Pandora spokeswoman Mollie Starr told Reuters.

The case is in re Broadcast Music Inc vs Pandora Media Inc, Case No. 13-4037, U.S. District Court, Southern District of New York.

As the huge animals thundered into the entrance of the tunnel, they were blocked by a mound of dozens of people who had fallen and were piled on top of one other.

One bull that had fallen before the entrance got up and charged into the clogged passageway. Two steers jumped over the pile of people as they began to get up and flee.

"I felt anguish and helplessness for the people trapped there, not knowing how to get out," said Jesus Lecumberri, 20, a student with several years' experience running at Pamplona and other bull-running festivals.

Lecumberri said he had charged in to the entrance alongside the first bull, but saw the pileup and quickly dived into a ground-level hatch built into the passage specifically to provide an escape route from situations like this.

A gate normally used to let regional police into ringside positions had been accidentally pushed wide open by a flood of runners, causing an obstruction for others trying to enter the main arena, Interior Ministry regional spokesman Javier Morras said.

"We all know that alley is a funnel and a critically dangerous point at the entrance to the ring," Morras said. "Pileups there are one of the biggest risks that can occur in the running of the bulls," he said.

The blockage ended after attendants managed to let the beasts escape through a side door normally reserved for matadors.

Javier Sesma, a health spokesman for Navarra province, said two of the 23 injured people were gored by bulls and that the others were hurt in the stampede.

Sesma said one runner, a 19-year-old Spaniard from Vitoria city, was seriously injured when his thorax was crushed, causing him to stop breathing at the bull ring entrance. An Irish citizen also had problems breathing because of the weight of people on top of him.

"His situation remains very grave, but he appears to be evolving favorably," Sesma said of the Spaniard. "We are hopeful. His life was at risk, but he is now more stable."

The American gored Saturday is a 35-year-old from Cleveland, Ohio, who is being identified only by the initials I.L., hospital officials said. A 19-year-old Spaniard from the city of Azpeitia was gored in an armpit during the 928-yard (850-meter) dash through Pamplona's narrow streets, a statement said.

The American was undergoing surgery Saturday afternoon after suffering a "rectal perforation," the Navarra government, which organizes the annual festivities, said in a statement.

One of those gored had received treatment in one of the two operating rooms at the bullring, Sesma said. The rest of the injured sustained cuts and bruises.

Sesma said one spectator had a heart attack while watching the stampede. By late afternoon, 16 of the injured had been discharged from hospitalization, Sesma said.

On Friday, the festival drew widespread attention when an American college student and two Spaniards were gored, and videos and photos of the attacks were seen around the world.

The American patient, 20-year-old Patrick Eccles, a student at the University of Utah, was said to be improving in a hospital Saturday. "He is evolving favorably but, logically, has had a severe goring and is still weak," hospital spokeswoman Marta Borruel said.

Javier Solano, a San Fermin expert working for national broadcaster TVE, said the first recorded pileup happened in 1878, and that two such blockages in 1975 and 1977 had led to several deaths.

The number of revelers attending the festival tends to swell at weekends, causing the narrow streets of Pamplona to be thronged with runners, increasing the risk of pileups and injuries.

The festival in this northern city dates back to the late 16th century and also is known for its all-night street parties.

The runs, eight in all, are the highlight of a nine-day street festival to honor Pamplona's patron saint, San Fermin.

Each morning, six fighting bulls and six bell-tinkling steers that try to keep the beasts together head from stables to the ring where matadors will star in late afternoon bullfights.

The festivities, which end Sunday, were made famous by Ernest Hemingway's 1926 novel "The Sun Also Rises."

The fiesta attracts tens of thousands of young people, many from abroad, eager to mix alcohol with the adrenaline of running alongside the massive bulls at 8 o'clock every morning.

Dozens of people are injured each year, with gorings often producing the most dramatic injuries.

The last fatal goring happened in 2009.

CALGARY, Alberta (Reuters) - By last Friday morning in Canada's oil capital, the scope of the disaster facing Calgary was becoming clear, and the reputation of the city's first-term mayor was rising along with the floodwaters.

As the two rivers in the city of 1.1 million reached new heights in the worst flooding the province of Alberta has ever seen, a growing list of neighborhoods were evacuated and the downtown home to Canada's largest oil companies was shut down as electrical substations failed.

In the chaos, Naheed Nenshi, the first Muslim elected to the office in a major North American city, was a ubiquitous presence - at media briefings, on Twitter, updating the status of city services, reminding Calgarians to stay safe and praising emergency workers. His well-timed jokes lightened the mood.

It was disaster management reminiscent, albeit on a smaller scale, of other North American politicians like New York Mayor Rudy Giuliani after the September 11 attacks and New Jersey Governor Chris Christie in the wake of Hurricane Sandy whose images were burnished by their performances in crises.

"As mayor (in these floods) I have three jobs," the 41-year-old Nenshi told Reuters in an interview sandwiched between media briefings, tours of damaged neighborhoods and visits to thank the city's thousands of volunteers.

"No. 1 is to make sure citizens have a lot of information on how to keep themselves safe. No. 2 is provide encouragement and resources to the real heroes. And No. 3 is to get out of the way and let people do their work. That's what I have been trying to do since the whole thing started."

The economic cost of the floods will likely reach into the billions. But Nenshi's response has won him the sort of national acclaim that eludes other big-city Canadian mayors these days.

Toronto's Rob Ford is under fire after two media outlets said they had seen a video that appeared to show him smoking crack cocaine (he says he does not smoke crack), while Montreal's Michael Applebaum has stepped down to fight charges of corruption.

"Mr. Nenshi has been such a superbly effective leader during the flood that has devastated his city and other Alberta communities that he appears on his way to folk-hero status," the Globe and Mail newspaper said in an editorial on Monday.

'I MUST LOOK TERRIBLE'

Even as the floodwaters rose, Nenshi maintained the Twitter presence that helped the left-leaning candidate win a surprise 2010 election victory in a city best known for sending conservatives to provincial and federal office. He is running for re-election this year, with little serious opposition.

But Nenshi says Calgary voters are not interested in ideology.

"We are a true meritocracy. Nobody in Calgary cares who your daddy was, what you look like or where you went to school," he said. "They only care about what you bring to the table and how hard you work. This boring characterization of black, white, red, blue - I don't think it has any bearing on people's choices. People just want folks who do a good job."

Before he was elected, Nenshi was a civic activist and business professor at Mount Royal University, known for being a frequent critic of Calgary's fractious City Council. Born in Toronto, he was raised in Calgary by parents who emigrated from Tanzania. As mayor, he earns about C$200,000 and donates 10 percent of it to charity.

He was a dark-horse challenger in the 2010 race for Calgary mayor - experts thought a long-serving councilor with conservative leanings had the election locked up.

Nenshi ran a grassroots campaign on a limited budget that harnessed Twitter and other social media. Starting out as an outsider, his support surged in the final weeks of the campaign.

Even before the crisis, ThinkHQ opinion research firm put Nenshi's approval ratings at 73 percent, down from an almost 88 percent as the city debated what to do with a tax refund from the provincial government.

It is the sort of number that often tempts local politicians to aim for higher office. But Nenshi said he had no ambitions to vie for another job.

"I have the best job in Canada, plus I can never remember what it is the federal government does," he said. "Or I should say they send in the army to help when you have flooding, for which we are very grateful."

His relentless pace and increasingly haggard appearance after round-the-clock briefings spawned the Twitter tag #nap4nenshi, which includes pictures of "Supernenshi", with his chubby face Photoshopped onto a picture of Superman.

"Everybody asks me the question about how much sleep I have had, which means I must look terrible," Nenshi said.

In one instance, Senate Republicans formally backed a lawsuit challenging the president's appointment of three members of the National Labor Relations Board without confirmation. The Supreme Court has agreed to review a ruling in the case, which found that Obama overstepped his bounds.

Most recently, the White House's decision to postpone a key part of the president's health care law drew rhetorical denunciations Tuesday from Republicans who, ironically, want to see the law repealed in its entirety.

Senate Republican leader Mitch McConnell of Kentucky said the action was part of a pattern of "indifference to the rule of law on the part of this administration. ... He did it with immigration. He did it with welfare work requirements. And he did it with the NLRB when he took it upon himself to tell another branch of government when it was in recess.

"And now he's doing it again with his own signature health care law," said McConnell, who is seeking re-election next year in a state where Obama is unpopular.

White House press secretary Jay Carney had no comment on McConnell's complaint that the administration is indifferent to the rule of law. The White House disputes each allegation in turn, citing specific legal authority for the president's actions, or saying the assertion was factually incorrect.

Oddly enough, on one particularly incendiary issue, Obama so far has rejected suggestions that he has authority to continue government borrowing without a vote by Congress to raise the debt ceiling. To switch course would inevitably invite a lawsuit.

Whatever the merits of the Republican claims, they sometimes include a dose of politics of the sort they accuse Obama of playing.

Rep. Steve King, R-Iowa, threatened to sue when Obama announced several weeks before the 2012 election that he would stop deportation proceedings against many younger immigrants who are in the country illegally, so long as they went to college or served in the military. The move was widely viewed as a gesture to Hispanic voters, many of whom live in key battleground states.

A suit subsequently was filed by federal immigration enforcement agents, and King was not a party to it, although his office says it was the product of a meeting he called. King also used the issue to raise money for his own re-election to Congress last fall, emailing potential donors that Obama "refuses to enforce immigration laws."

In addition to challenging Obama's adherence to the rule of law, McConnell's speech included a pre-emptive attack in case Democrats try to change Senate rules this summer and make it easier to confirm presidential appointees.

"I know Washington Democrats are getting a lot of pressure from big labor union bosses and other far-left elements of their base to do this," the Kentucky Republican said. "These folks have told Democrats it's time to pay up, and they don't have much time for things like the democratic process or the rule of law."

He spoke at about the same time House Democrats and union leaders held a news conference to pressure Republicans not to block confirmation for several appointments, including at the NLRB, which rules on collective bargaining disputes between employees and companies.

"Whatever it takes to get these nominees through, an up or down vote is what we want," said Bill Samuel, the AFL-CIO's legislative director. "That might very well include a change in the rules to make it impossible for the Republicans to filibuster the nominations."

The lawsuit backed by Senate Republicans challenged Obama's so-called recess appointments of three members of the NLRB.

The Constitution gives the president authority to make appointments without confirmation when the Senate is in recess. In the case at issue, Obama acted at a time Congress was away on an extended holiday break, but the Senate met every three days as part of an explicit strategy by Republicans to prevent such appointments.

Rejecting the administration's arguments, a three-judge panel of the U.S. Court of Appeals in Washington, D.C., ruled that recess appointments can be made only during the once-a-year break between sessions of Congress, typically at the end of the year.

Two judges on the panel also ruled that to qualify for a recess appointment, a position must become vacant while the Senate is in recess.

Despite Republican allegations, administration officials cite specific legal authority for some of Obama's actions.

The Treasury Department said the one-year waiver of the requirement for companies to provide health insurance announced last week was "an exercise of the administrative authority" granted by law when it comes to implementing new legislation like the health care act.

One official cited other recent examples of waivers under the same authority. A case in 2011 said aviation excise taxes that had lapsed and then been reinstated would not be applied for a three-week period ending the day Congress re-enacted them.

The other, from 2007, related to standards for penalties on income tax preparers, according to the official, who citing department regulations in speaking on condition of anonymity.

A year ago, when Obama announced the shift in immigration policy, Homeland Security Secretary Janet Napolitano cited "prosecutorial discretion."

McConnell's reference to welfare relates to a charge by Republicans that the administration proposed new rules to lessen the work requirements implemented as part of a 1996 overhaul of the program. The White House denies the proposal had that effect.

The carnage outside the Republican Guard building in Cairo where toppled President Mohammed Morsi was first held last week marked the single biggest death toll since massive protests forced Morsi's government from power and brought in an interim civilian administration.

Even before all the bodies were counted, there were conflicting accounts on how the violence began with Morsi's backers saying it was an unprovoked attack and the military saying they came under assault first.

But the violence is almost certain to draw sharper battle lines between Morsi's Muslim Brotherhood and their opponents who claim Morsi squandered his 2012 election victory and betrayed the democratic spirit of Egypt's 2011 revolution by seeking only to bolster his and the Brotherhood's grip on the state.

Soon after the attack, however, the Al-Nour party, an ultraconservative party that had been talking to the new government about participating in the political process, announced it was withdrawing its support for the transition plan in response to the "massacre."

The military, which effectively supported the anti-Morsi movement, now may face pressures to impose stricter security measures to try to keep unrest from spilling out of control. It will also have to produce compelling evidence to support its version of events or otherwise suffer what is already shaping to be a Brotherhood media blitz to portray the military as a brutal institution with little regard for human life or democratic values.

In a move that is likely to further inflame the situation, the Freedom and Justice party, the Muslim Brotherhood's political arm, called on Egyptians to rise up against the army. Morsi has been a longtime leader of the Brotherhood.

The Freedom and Justice party also called on the international community to stop what it called the massacres in Egypt and accused the military of pushing Egypt toward civil war, warning the country was in danger of becoming a "new Syria."

Interim President Adly Mansour called for restraint and ordered a judicial inquiry into the killings. Significantly, the statement from his office echoed the military's version of events, noting that the killings followed an attempt to storm the Republican Guard's headquarters.

Pro-reform leader Mohamed ElBaradei condemned the violence and also called for an investigation.

"Peaceful transition is (the) only way," he wrote on his Twitter account.

A military spokesman said gunmen attempted to storm the building at dawn, prompting the clashes. One witness, university student Mirna el-Helbawi, also said gunmen loyal to Morsi opened fire first, including from the roof of a nearby mosque. El-Helbawi, 21, lives in an apartment overlooking the scene.

Supporters of Morsi, meanwhile, said the security forces fired on hundreds of protesters, including women and children, at a sit-in encampment outside the building as they performed early morning prayers. It was not immediately possible to reconcile the two versions.

Regardless of the reason, the escalating chaos will further complicate Egypt's relations with Washington and other Western allies, which had supported Morsi as the country's first freely elected leader and now are reassessing policies toward the military-backed group that forced him out.

At field hospitals, at least six dead bodies had been laid out on the ground, some with severe wounds, according to video from by pan-Arab broadcaster Al-Jazeera. The bodies had been draped with an Egyptian flag and pictures of Morsi. Pools of blood covered the floor and doctors struggled to deal with gaping wounds among some of the hundreds injured.

A medic from the area, Hesham Agami, said ambulances were unable to transport more than 200 wounded to hospitals because the military had blocked off the roads. Health Ministry spokesman Khaled el-Khatib said initial reports indicated at least 40 fatalities and 322 people wounded, although he gave no details on the circumstances of the bloodshed.

A Muslim Brotherhood spokesman, Mourad Ali, said army troops opened fire at dawn on the protesters outside the Republican Guard building, where Morsi was initially held but was later moved to an undisclosed Defense Ministry facility. The account was repeated by others.

"They opened fire with live ammunition and lobbed tear gas," said Al-Shaimaa Younes, who was at the sit-in. "There was panic and people started running. I saw people fall."

Egyptian state TV showed images provided by the military of the scene of the sit-in, where scores of protesters were pelting troops with rocks and setting tires on fire. Soldiers in riot gear and carrying shields formed lines a few meters (yards) away.

A fire raged from an apartment in a building overlooking the clashes. Images showed men throwing spears from atop nearby building rooftops. Other protesters were lobbing fire bombs at the troops. It was not clear when the footage was filmed. Security officers were showing cameras bullet casings, and troops were carrying injured colleagues.

Military spokesman Col. Ahmed Mohammed Ali said initial information indicates that gunmen affiliated with the Brotherhood tried to storm the Republican Guard building shortly after dawn, firing live ammunition and throwing firebombs from a nearby mosque and rooftops. One police officer on the scene was killed, he said.

A statement by the armed forces carried by the state news agency said "an armed terrorist group" tried to storm the building, killing one officer and seriously wounding six. The statement said the forces arrested 200 attackers, armed with guns and ammunition.

Ali, the Brotherhood spokesman, dismissed such versions, saying the protesters didn't start the confrontation. He said the military had warned protesters it will break up the sit-in.

Morsi supporters have been holding rallies and a sit-in outside the Republican Guard building since the military deposed Morsi on Wednesday. The military chief replaced Morsi with an interim president until presidential elections are held. The transition plan is backed by liberal and secular opponents of Morsi, and had been also supported by the ultraconservative Islamist Al-Nour party and both Muslim and Christian religious leaders.

Al-Nour party spokesman Nader Bakkar said on his Twitter account his party is withdrawing its support for the transition plan in response to the "massacre."

Morsi's supporters refuse to recognize the change in leadership and insist Morsi be reinstated, and have vowed to continue their sit-ins outside the Republican Guard building as well as at a nearby mosque.

Morsi's opponents are also holding rival rallies. They say the former president lost his legitimacy by mismanaging the country and not ruling democratically, leading to a mass revolt that began June 30, the first anniversary of Morsi's assumption of power.

Meanwhile, attention focused on the CEO of the railway's parent company, who faced jeers from local residents and blamed the train's engineer for improperly setting its brakes before the disaster.

Quebec Premier Pauline Marois arrived in Lac-Magentic to tour the disaster site on Thursday, a day after officials said that 20 bodies had been found in this burned-out town, and 30 people were missing, presumed dead.

"We informed them of the potential loss of their loved ones," said Quebec police inspector Michel Forget, who came to an afternoon news briefing from a meeting with families of the dead and missing. "You have to understand that it's a very emotional moment."

Edward Burkhardt, the head of the train's U.S.-based parent company blamed the engineer for failing to set the brakes properly before the unmanned Montreal, Maine & Atlantic Railway train hurtled down a seven-mile (11-kilometer) incline, derailed and ignited in the center of Lac-Megantic early Saturday. All but one of its 73 cars was carrying oil, and at least five exploded.

The crash has raised questions about the rapidly growing use of rail to transport oil in North America, especially in the booming North Dakota oil fields and Alberta oil sands far from the sea.

The intensity of the explosions and fire made parts of the devastated town too hot and dangerous to enter and find bodies days after the disaster. Only one body had been formally identified, said Genevieve Guilbault of the coroner's office, and she described efforts to identify the other remains as "very long and arduous work."

Burkhardt, president and CEO of the railway's parent company, Rail World Inc., faced jeers from residents and scorn from Quebec's premier as he made his first visit to the town since the disaster. He was expected to meet with residents and the mayor Thursday.

Burkhardt said the train's engineer had been suspended without pay and was under "police control."

Investigators also had spoken with Burkhardt during his visit, said a police official, Sgt. Benoit Richard. He did not elaborate.

Until Wednesday, the railway company had defended its employees' actions, but that changed abruptly as Burkhardt singled out the engineer.

"We think he applied some hand brakes, but the question is, did he apply enough of them?" Burkhardt said. "He said he applied 11 hand brakes. We think that's not true. Initially we believed him, but now we don't."

Burkhardt did not name the engineer, though the company had previously identified the employee as Tom Harding of Quebec. Harding has not spoken publicly since the crash.

"He's not in jail, but police have talked about prosecuting him," Burkhardt said. "I understand exactly why the police are considering criminal charges ... If that's the case, let the chips fall where they may."

Investigators are also looking at a fire on the same train just hours before the disaster. A fire official has said the train's power was shut down as standard operating procedure, meaning the train's air brakes would have been disabled. In that case, hand brakes on individual train cars would have been needed.

The derailment is Canada's worst railway disaster since a train plunged into a Quebec river in 1864, killing 99.

Quebec police have said they were pursuing a wide-ranging criminal investigation, extending to the possibilities of criminal negligence and some sort of tampering with the train before the crash. The heart of the town's central business district is being treated as a crime scene and remained cordoned off by police tape.

At a news conference shortly before Burkhardt's arrival, the Quebec Premier faulted his company's response.

"We have realized there are serious gaps from the railway company from not having been there and not communicating with the public," Marois said. She depicted Burkhardt's attitude as "deplorable" and "unacceptable."

Burkhardt, who arrived in town with a police escort, said he had delayed his visit in order to deal with the crisis from his office in Chicago, saying he was better able to communicate from there with insurers and officials in different places.

"I understand the extreme anger," he said. "We owe an abject apology to the people in this town."

In an exchange with reporters, Burkhardt defended the practice of leaving trains unmanned, as was the case when the train rolled away. Canadian transportation department officials have said there are no regulations against it.

"For the future we, and I think probably the rest of the industry, aren't going to be leaving these trains unmanned," Burkhardt said. "We'll take the lead with that. I think the rest of the industry is going to follow."

Among the residents looking on as Burkhardt spoke was Raymond Lafontaine, who is believed to have lost a son, two daughters-in-law and an employee in the disaster.

"That man, I feel pity for him," Lafontaine said. "Maybe some who know him properly may think he's the greatest guy in the world, but with his actions, the wait that took place, it doesn't look good."

The disaster forced about 2,000 of the town's 6,000 residents from their homes, but most have been allowed to return.

Sarah Guyard-Guillot was pronounced dead late Saturday night at a hospital after falling about 50 feet from the show's stage.

Witnesses told the Las Vegas Sun (http://bit.ly/14H3Te0 ) that the accident occurred near the end of the production Saturday night at the MGM Grand.

Visitor Dan Mosqueda of Colorado Springs, Colo., said the 31-year-old acrobatic performer was being hoisted up the side of the stage when it appeared that she slipped free of her safety wire and plummeted to an open pit below the stage.

"Initially, a lot of people in the audience thought it was part of the (show)," he told the Sun. "But you could hear screaming, then groaning, and we could hear a female artist crying from the stage."

The show momentarily continued, then stopped. Minutes after the accident, a recorded announcement informed audience members that refunds or vouchers to future shows would be offered, and the crowd was dismissed.

Cirque du Soleil founder Guy Laliberte issued a statement Sunday praising Guyard-Guillot and saying performances of "Ka" have been canceled until further notice.

Guyard-Guillot, a mother of two children, had been with the original cast of "Ka" since 2006, and had been an acrobatic performer for over 20 years.

"I am heartbroken. I wish to extend my sincerest sympathies to the family. We are all completely devastated," Laliberte said. "We are reminded with great humility and respect how extraordinary our artists are each and every night. Our focus now is to support each other as a family."

Cirque officials are working with authorities investigating the accident and have offered their full cooperation, he added.

The Clark County Coroner's Office will rule on the cause of death.

The MGM Grand also issued a statement concerning the accident.

"Our company is deeply saddened by the loss of one of the talented KA artists Saturday night," it reads. "The thoughts and prayers of our employees are with the performer's family, the cast of KA, and the entire Cirque family during this difficult time."

The accident occurred while Cirque's top executives, including president Daniel Lamarre, were in Las Vegas to celebrate the premiere of "Michael Jackson One" at Mandalay Bay.

On Wednesday night, a performer in a preview performance of that show suffered a mild concussion after missing the protective pad below an act and landing on the stage. That artist is expected to return to the show.
