CENTENNIAL, Colo.After a judge allowed Aurora, Colo., shooting suspect James Holmes to plead not guilty by reason of insanity on Tuesday, he dealt a major setback to the defense by granting the prosecution access to a key piece of evidence.

By Monday at the earliest, prosecutors will get to see a notebook and package Holmes mailed to his university psychiatrist, Dr. Lynne Fenton, days before the July 20, 2012, shooting spree. Fenton never received the package, and it has since been sealed.

Judge Carlos A. Samour ruled that any evidence pertaining to Holmes mental illness was no longer shielded by doctor-patient privilege now that the court has accepted the insanity plea. This includes the notebook, which defense attorney Daniel King argued was a unique piece of evidence that the prosecution shouldnt see because Fenton herself hadnt seen it, and it could have altered her opinion of Holmes mental health.

The argument advanced by Mr. King is a creative one, Samour said on Tuesday, but I am not persuaded by it.

Under Colorado statute, once a defendant pleads insanity, any evidence related to mental illness is no longer protected and is covered under an evidence waiver.

The release of the notebook and the insanity plea mark significant movement in the case, which has been mired in arguments over the notebook and Colorados laws related to capital punishment.

Holmes is accused of fatally shooting 12 Aurora movie theater patrons last summer during a midnight screening of The Dark Knight Rises, the latest Batman movie. Fifty-eight others were injured. The Arapahoe County district attorney is seeking the death penalty.

Marcus Weaver, a victim who was shot in the arm, hailed Tuesdays developments.

The trial is moving forward finally, Weaver said after the hearing. I feel it is a step forward for a lot of the victims. Were happy there is momentum.

The decision is a defeat to Holmes defense team, which since August has sought to keep the prosecution and other witnesses from learning the contents of the notebook, which reportedly contains violent imagery and detailed descriptions of the attack. Law enforcement officials thumbed through the notebook in the University of Colorados mail room days after the shootings. But because the court ruled last fall that Holmes was under Fentons psychiatric care at the time, lawyers and witnesses couldnt discuss or see the notebooks contents.

Also at Tuesdays hearing, Samour advised Holmes that the state will administer an evaluation at the Colorado Mental Health Institute in Pueblo, south of Denver. The exam will be finished by Aug. 2 after the doctors and clinicians conducting the exam sift through thousands of pages of evidence provided by prosecutors.

Every person is presumed to be sane, Samour said.

However, he noted that in Colorado, once an issue of insanity is raised, the burden is on the prosecution to prove the defendant is sane. The judge will allow Holmes defense team to have a doctor of its choice also evaluate Holmes.

, Samour denied the defenses request for more time to prepare to discuss the notebook in court.

The privilege issue related to the [notebook] has been briefed and discussed before, Samour wrote. It is true, of course, that the defendants not guilty by reason of insanity plea, if accepted, may alter the analysis, but the parties have been aware of that for some time.

Indeed, attorneys haveas far back as August, when prosecutors tried to convince the first judge in the case that Fenton was more akin to a general practitioner than a mental health professional and, thus, the notebook wasnt privileged. The prosecution abandoned its quest for the notebook at the time.

Samour read a lengthy advisement to Holmes during the hearing that detailed what his insanity plea means, including what happens to Holmes should he not cooperate with the mental illness exam. The defense lost its bid last week to strike down portions of Colorado state law, arguing that government psych exams could violate Holmes right to a fair trial in a capital case.

The hearing, originally scheduled for last Thursday, was moved to Tuesday at the defenses request. The prosecution agreed on the condition the hearing would address the notebook privilege issue.

, noting that it was pulling extremely long hours to comply with the courts Monday deadline on noncapital-punishment motions as well as work related to Holmes insanity plea.

Counsel simply cannot complete all the work that needs to be done on those motions, the defense wrote in that filing.

The defense filed dozens of motions late Monday, most related to noncapital issues, including a request to move the trial to a different Colorado county.

T-Mobile USA began selling the BlackBerry Q10 on Wednesday. It has Research In Motion Ltd.'s new BlackBerry 10 operating system, which addresses shortcomings that allowed the iPhone and Android devices to surpass the once-pioneering BlackBerry in sales and prestige.

Verizon, AT&T and Sprint also have plans to sell the Q10 in the U.S. Verizon Wireless started taking orders last week and says it will ship by Thursday. AT&T started taking orders Wednesday. Neither Verizon nor AT&T Inc. has said when it will have the phones in stores. The last of the major national carriers, Sprint Nextel Corp., has said it will carry the phone this summer.

RIM's chief operating officer, Kristian Tear, said that he doesn't regret RIM's decision to release a touch version first, even though it was new territory for the company. Many long-time BlackBerry users prefer a physical keyboard, which has been RIM's strength.

"It's obviously a larger market size, the full touch," he said in an interview. "I think it was right to do that No. 1. To get Q10 out now, not too long after, is a good second step."

The BlackBerry, pioneered in 1999, had been the dominant smartphone for on-the-go business people and other consumers before the iPhone debuted in 2007 and showed that phones can handle much more than email and phone calls. RIM faced numerous delays modernizing its operating system with the BlackBerry 10. During that time, it had to cut more than 5,000 jobs and saw shareholder wealth decline by more than $70 billion.

RIM's touch-only devices in the past haven't been successful. Meanwhile, its rivals have largely abandoned efforts at making smartphones with physical keyboards. That's an area RIM long has been strong in.

Tear said loyal Blackberry users are eager to upgrade to the Q10, and he expects RIM to win back people who had left for rival devices.

Colin Gillis, an analyst at BGC Partners, said the keyboard version has a much greater chance at success than the touch version. He calls the Z10 just another slab of glass that doesn't differentiate much what rivals offer. He said RIM's base has always favored the keyboard.

"That's why I always found it kind of odd that they didn't lead with the strength," Gillis said.

Nonetheless, RIM surprised Wall Street in March by returning to profitability and shipping about 1 million touch-screen BlackBerry Z10 phones in the quarter that ended March 2. It will take several quarters, though, to know whether the Canadian company is on a path toward a successful turnaround.

Jefferies analyst Peter Misek said it was smart to start with touch to give the Z10 a chance. Otherwise, he said, people might not have tried it and just gone to the Q10 and its keyboard.

Misek, however, has said that retail checks in the U.K. and Canada show that demand is higher for the Q10 than the Z10. The Q10 has been available in Canada, the U.K. and other countries since early May. The Z10 has been available in Canada and the U.K. for several months and in the U.S. since late March. RIM CEO Thorsten Heins has said U.S. carrier testing of the new BlackBerry 10 software is the reason for the delayed launch in the U.S.

RIM's stock increased 9 cents, or less than 1 percent, to close Wednesday at $13.63.

A posting on the Lilly Pulitzer Facebook page said she "passed away peacefully in Palm Beach, [Fla.] surrounded by family and loved ones."

"Lilly has been a true inspiration to us and we will miss her," the post said. "In the days and weeks ahead we will celebrate all that Lilly meant to us. Lilly was a true original who has brought together generations through her bright and happy mark on the world."

Born Lillian McKim, she attended the tony Miss Porter's school in Farmington, Conn., where the future first lady, Jacqueline Kennedy, was among her classmates.

Lilly married Peter Pulitzer, grandson of newspaper mogul Joseph Pulitzer.

The couple moved to Palm Beach, Fla., where they had three children: Peter, Minnie and Liza.

Despite having money and being well-known on the society circuit, Pulitzer toldshe was so miserable that she landed in a Westchester, N.Y., mental hospital for six months.

"I went crazy," Pulitzer told the magazine in 1982. "I was a namby-pamby; people always made decisions for me. The doctor said I should find something to do."

Pulitzer began juicing citrus grown at her family's groves, but was always covered in juice at the end of the work day.

She designed herself a shift dress to match the juice stains. It received so many compliments that she launched her first fashion line in 1959 -- just a few dresses -- at her juice stand.

The dresses were a hit, and Pulitzer entered the fashion business full-time.

"It was a total change of life for me," she toldin 2008. "I entered it with no business sense. ... It was just something that I all of a sudden took over."

The brand reached new heights when Pulizter's former classmate, Jackie Kennedy, was photographed wearing one of her dresses while on vacation, according to the Lily Pulitzer website.

"Jackie wore one of my dresses -- it was made from kitchen curtain material -- and people went crazy. They took off like zingo. Everybody loved them, and I went into the dress business," Pulitzer said.

She divorced Peter Pulitzer in 1969 and that year married Cuban lawyer Enrique Rousseau, who died in 1993.

Through the years, Pulitzer's brand expanded to include country club attire, swimsuits, children's clothing, home goods and a limited selection of menswear.

Despite grossing millions of dollars each year, Pulitzer shut down her closing line in 1984 when sales began to slump.

The Lilly Pulitzer revival came a decade later when she sold the license in 1993, stepping away from the daily business grind but remaining as a consultant.

The free-spirited socialite known for going barefoot whenever possible, continued to host parties at her Florida home and published two guides to entertaining, reveling in her belief that "it's always summer somewhere."

Thelaunched into space on April 19 atop a Russian-built Soyuz 2 rocket from Baikonur Cosmodrome in Kazakhstan. On Sunday (May 19) the capsule came back to Earth, guided with the help of a parachute system to the ground in Russia's Orenburg region. It is the longest animal astronaut mission of its kind.

Space officials reportedly discovered that more than half of the 45 mice aboard the spacecraft died during the flight, the. All eight Mongolian gerbils and many of the other critters also did not survive, but all 15 geckos did survive, the news service reported. []

According to Russian scientists, some losses were to be expected during the flight, and the mission still promises to yield valuable data from experiments on how space travel affects living things. The capsule spent 30 days orbiting 357 miles (575 kilometers) above Earth.Scientists planned to humanely euthanize the animals after their return to Earth in order to complete the experiments.

Animals have been launched into orbit in the past. In the early days of spaceflight, both the United States and the Soviet Unionto test the safety of launching humans into orbit. But the Bion-M1 mission marks longest experiment of its kind.

"This is the first time that animals have been put in space on their own for so long," Vladimir Sychov of the Russian Academy of Sciences was quoted as saying byAFPin announcing the capsule's return. Sychov added that "less than half of the mice made it but that was to be expected."

The project was run by Russia's Federal Space Agency, also called Roscosmos, but an international team of scientists was overseeing the mission's experiments. It was the first Russian space mission to launch animals into orbit in 17 years. Prior to Bion-M1, the most recent animal space mission for Russia was a Bion flight that sent rhesus monkeys, geckos and amphibians into orbit for 15 days in 1996.

Nicole Rayl, project manager for NASA's portion of the Bion-M1 animal astronaut mission,told SPACE.com in Aprilthat the flight would be important because of its duration and because it would allow scientists to analyze data with tools that weren't available to them during previous similar missions.

Scientists had prepared a battery of experiments designed to test how space travel would affect the bodies of the animals. One of the NASA experiments was aimed at studying how microgravity and radiation would impact sperm motility in mice. With eye toward long, interplanetary missions, Rayl said that test would be important to help determine if humans can procreate from.

According to the, the animals were to be flown to Moscow after landing to undergo a series of tests at the Russian Academy of Sciences' Institute of Medical and Biological Problems, where Sychov is deputy director.
