<![CDATA[ Austrian daredevil Felix Baumgartner became the first skydiver to break the speed of sound in a 24-mile-high jump from a balloon on Sunday, reaching 833.9 mph in a descent that lasted some 9 minutes.<p></p><p>Landing on his feet in the New Mexico desert, the man known as "Fearless Felix" lifted his arms in victory to the cheers of onlookers and friends.</p><p>"When I was standing there on top of the world, you become so humble, you do not think about breaking records anymore, you do not think about gaining scientific data," he said after the jump. <title>NHL negotiations go late. No union discl</title>

<![CDATA[ NEW YORK (AP)  Hockey players are sticking together as a union for now and are working long and late hours with the NHL to try to reach a new collective bargaining agreement to get the game back on the ice.<p></p><p>The sides met in small groups throughout the day Wednesday and then held a full-scale bargaining session with a federal mediator at night that lasted nearly five hours and didn't wrap up until about 1 a.m. Thursday.</p><p>They planned to get back at it less than 10 hours later.</p><p>The biggest detail to emerge from Wednesday night's marathon talks was that Donald Fehr is still the executive director of the players' association, which passed on its first chance to declare a disclaimer that would dissolve the union and turn it into a trade association.</p><p>Last month, players voted overwhelmingly in favor of giving the union executive board the right to declare the disclaimer, but that permission expired at midnight Wednesday. The disclaimer would allow individual players to file antitrust lawsuits against the NHL.</p><p>Fehr wouldn't address the issue at all, calling it an "internal matter," but NHL Commissioner Gary Bettman said all the union would need to do is inform the league that it was taking the action for it to happen.</p><p>"The word disclaimer has yet to be uttered to us by the players' association," Bettman said. "It's not that it gets filed anywhere with a court or the NLRB. When you disclaim interest as a union, you notify the other side. We have not been notified and it's never been discussed, so there has been no disclaimer."</p><p>Even though the deadline expired, a new vote by players can be held anytime to restore the authorization.</p><p>"All I can tell you about that is the players retain all the legal options they have always had and we don't talk about legal matters," Fehr said.</p><p>The thought was that the union wouldn't take action Wednesday if it saw progress was being made. Neither side would characterize the talks or address what, if any, movement toward common ground was reached.</p><p>Both the league and the players were tightlipped about how many things still need to be worked out and what topics are keeping them apart. But the discussions went well enough for the NHL and the union to agree to the mediator's request to start talking again at 10 a.m. Thursday.</p><p>"I'm not going to get into the details," Bettman said. "There's been some progress but we're still apart on a number of issues. As long as the process continues I am hopeful."</p><p>Bettman has told the union that a deal must be in place by Jan. 11 in order for a 48-game season to be played beginning eight days later.</p><p>The night session Wednesday began shortly after 8 p.m. EST. The sides also met for about an hour during the afternoon when the union gave its latest proposal to the league, a response to the NHL's counteroffer on Tuesday.</p><p>Neither side said much regarding Wednesday's discussions, but it is believed that the pension issue has become a major stumbling block.</p><p>"The pension plan is a very complicated issue," Bettman said. "The number of variables and the number of issues that have to be addressed by people who carry the title actuary or pension lawyer are pretty numerous and it's pretty easy to get off track.</p><p>"That is something we understand is important to the players."</p><p>The union's proposal Wednesday makes four offers between the sides since the NHL restarted negotiations Thursday with a proposal.</p><p>A small group meeting on the pension issue was held Wednesday morning before the players' association presented its offer. A deal can't be done without a resolution on pensions.</p><p>The league presented the players with a counteroffer Tuesday night in response to one the union made Monday.</p><p>The lockout reached its 109th day Wednesday, and Bettman has said that the league told the union a deal needs to be in place by next week so a 48-game season can begin on Jan. 19. All games through Jan. 14 along with the All-Star game have been canceled, claiming more than 50 percent of the original schedule.</p><p>Fehr believed an agreement on a players-funded pension had been reached before talks blew up in early December. That apparently wasn't the case, or the NHL has changed its offer regarding the pension in exchange for agreeing to other things the union wanted.</p><p>The salary-cap number for the second year of the deal  the 2013-14 season  hasn't been established, and it is another point of contention. The league is pushing for a $60 million cap, while the union wants it to be $65 million.</p><p>In return for the higher cap number players would be willing to forgo a cap on escrow.</p><p>"We talk about lots of things and we even had some philosophical discussions about why particular issues were important to each of us," Bettman said. "That is part of the process."</p><p>The NHL proposed in its first offer Thursday that pension contributions come out of the players' share of revenues, and $50 million of the league's make-whole payment of $300 million will be allocated and set aside to fund potential underfunding liabilities of the plan at the end of the collective bargaining agreement.</p><p>Last month, the NHL agreed to raise its make-whole offer of deferred payments from $211 million to $300 million as part of a proposed package that required the union to agree on three nonnegotiable points. Instead, the players' association accepted the raise in funds, but then made counterproposals on the issues the league stated had no wiggle room.</p><p>"As you might expect, the differences between us relate to the core economic issues which don't involve the share," Fehr said of hockey-related revenue, which will likely be split 50-50.</p><p>The NHL is the only North American professional sports league to cancel a season because of a labor dispute, losing the 2004-05 campaign to a lockout. <title>Gay Men, Moms Sue NJ Conversion Therapis</title>

<![CDATA[ Four gay men and two of their mothers filed a lawsuit today against a New Jersey conversion therapy group that claims to rid men of same-sex attractions and turn them straight.<p></p><p>The lawsuit, filed in Superior Court of New Jersey Hudson County, alleges that methods used by the do not work and constitute fraud under the state's consumer protection laws.</p><p>Arthur Goldberg, JONAH's co-director, and Alan Downing, a "life coach" who provides therapy sessions, were also named in the suit.</p><p>The plaintiffs include Michael Ferguson, Benjamin Unger, Sheldon Bruck and Chaim Levin, all of whom used the services of JONAH when they were in their teens or young20s.</p><p>Two of the men's mothers, Jo Bruck and Bella Levin, who paid for therapy sessions that could cost up to $10,000 a year, were also plaintiffs.</p><p>One of the plaintiffs alleges that therapy sessions that involved a virtual "strip tease" in front of an older male counselor, as well as reliving abuse and homophobia were "humiliating."</p><p>They are seeking declaratory, injunctive and an undisclosed amount of monetary relief, as well as court costs, according to the lawsuit.</p><p>The plaintiffs have received legal help from the Southern Poverty Law Center (SPLC), which claims in the lawsuit that conversion therapy is a dangerous practice that has been "discredited or highly criticized" by every major American medical, psychiatric, psychological and professional organization.</p><p>Three of the young plaintiffs are from an ultra orthodox Jewish background; Ferguson came from a Mormon background and met Downing at a "Journey Into Manhood" retreat, according to the lawsuit.</p><p>JONAH appears to cater to orthodox Jews, but its methods "do not have a strong religious aspect," according to SPLC lawyer Sam Wolfe.</p><p>The lawsuit alleges that some of the methods used included: telling boys to beat a pillow, the "effigy of the client's mother," with a tennis racket; encouraging "cuddling" between younger clients and older male counselors; and even instructing attendees to remove their clothing and hold their penis in front of Downing.</p><p>Attendees were also subjected to ridicule as "faggots" and "homos" in mock locker room and gym class role playing, according to the lawsuit.</p><p>"It's definitely cruel and unusual and doesn't work," said Wolfe. "They are peddling bogus techniques that have no foundation in science and are basically ridiculous and even harmful."</p><p>Wolfe paraphrased JONAH's message as: "All you have to do is put in the work to overcome your sexual attractions. If you follow our program your true orientation emerges and will turn you into a straight person."</p><p>"Often if what the conversion therapist tells them doesn't work, it's their fault," Wolfe added.</p><p>In 2008, when the plaintiffs were seeking help from JONAH, the cost of an individual therapy session was $100 and for a group session, $60.JONAH also "strongly pushed" attending weekend retreats that could cost as much as $700, said Wolfe.</p><p>Arthur Goldberg said he "knows nothing about the lawsuit," which was filed this morning, and referred ABCNews.com to JONAH's website.</p><p>"We have a lot of people who were a success and were healed," he said of JONAH's 14 years in service. "Hundreds of the clients we serve are satisfied ... Our therapy is very conventional."</p><p>When asked about the group's practices, he said, "I can't tell you about the methodology." Goldberg admitted he had "no background specifically in counseling."</p><p>"I am the administrator," he said. "I used to teach family law."</p><p>When asked about instructing boys to take off their clothes, he said, "I know nothing about that."</p><p>Goldberg also said he had "no idea" how to reach Downing because he was an "independent contractor."</p><p>According toon its website, the nonprofit group is "dedicated to educating the world-wide Jewish community about the social, cultural and emotional factors which lead to same-sex attractions."</p><p>"Through psychological and spiritual counseling, peer support, and self-empowerment, JONAH seeks to reunify families, to heal the wounds surrounding homosexuality, and to provide hope," the statement reads.</p><p>JONAH's Goldberg, who runs the business side of the nonprofit, says on the website that "change from homosexual to heterosexual is possible  homosexuality is a learned behavior which can be unlearned, and that healing is a lifelong process."</p><p>According to the lawsuit, JONAH cites the "scientific" work of Joseph Nicolosi, one of the primary proponents of conversion therapy and Richard A. Cohen, who was permanently expelled from the American Counseling Association in 2002 for "multiple ethical violations."</p><p>Nicolosi's methodology is based on the belief that a weak father-son relationship and a dominating mother contribute to homosexuality. He advocates "rough and tumble games," as well as father-son showers, according to the lawsuit.</p><p>Cohen uses a technique called "bioenergetics" that includes having male patients beat a pillow, which represents their mother, as a way of stopping same-sex attraction, according to the lawsuit.</p><p>Conversion therapists also cite child abuse and bullying as a "primary cause" of homosexuality, according to the lawsuit.</p>APA Calls Gay Conversion Therapy Risky<p>The American Psychiatric Association and the World Health Organization, among other mental health groups, have cited the potential risks of reparation therapy, including "depression, anxiety [and] self-destructive behavior," according to the lawsuit.</p><p>Chaim Levin, the most vocal of the plaintiffs, is now 23 and a gay rights advocate who writes a blog, .</p><p>He grew up in a Jewish ultra orthodox community in Brooklyn where religious leaders threw him out of the Hebrew-speaking yeshiva at the age of 17, when they learned he was gay.</p><p>Levin told ABCNews.com that he had been abused as a boy and that he was "confused" by his sexuality and took a rabbi's advice and began 18 months of gay conversion therapy at JONAH.</p><p>[Levin , alleging he was abused for three years from the time he was 6.]</p><p>When Levin met co-director Goldberg, he said the defendant told him JONAH could change his sexual orientation, "as long as I tried hard enough and put enough effort into it."</p><p>"He told me, 'You will marry a woman and have a straight life,'" said Levin.</p><p>"Given where I came from, with three older siblings who were married with kids and not knowing any gay people or English, I was sure I could change," he said. "That was the theology."</p><p>Levin first did a retreat with Downing, then saw him weekly at therapy sessions in Jersey City.</p><p>"A lot of the therapy involves reliving the experience," he said. Levin alleges he was forced to relive the sexual abuse by his cousin, "with no counseling afterwards."</p><p>But the most "humiliating" experience, the one that Levin alleges made him quit therapy, was being asked by Downing to take off his clothes, article by article and told to touch his "private parts" -- to hold his penis in front of a mirror to "be in touch with my masculinity."</p><p>"I told him I wasn't comfortable, but I desperately wanted to change and was ready to do anything," said Levin. <title>House Republicans balk at &amp;quot;fiscal c</title>

<![CDATA[ WASHINGTON (Reuters) - Last-minute efforts to step back from the "fiscal cliff" ran into trouble on Tuesday as Republicans in the House of Representatives balked at a deal that would prevent Washington from pushing the world's biggest economy into a recession.<p></p><p>House Republicans complained that a bill passed by the Senate in a late-night show of unity to prevent a budget crisis contained tax hikes for the wealthiest Americans but no spending cuts. Some conservatives sought to change the bill to add cuts.</p><p>That would set up a high-stakes showdown between the two chambers and risk a stinging rebuke from financial markets that are due to open in Asia in a few hours.</p><p>The Senate would refuse to accept any changes to the bill, a Senate aide said, and it appeared increasingly possible that Congress could push the country over the fiscal cliff after all, despite months of effort.</p><p>Strictly speaking, the United States went over the cliff in the first minutes of the New Year because Congress failed to produce legislation to halt $600 billion of tax hikes and spending cuts that start kicking in on January 1.</p><p>But with financial markets and federal government offices closed for the New Year's Day holiday, lawmakers had a little more time to work out a compromise without real-world consequences.</p><p>The Senate bill drew overwhelming support from Republicans and Democrats alike when it passed by a vote of 89 to 8.</p><p>But Republicans who control the House expressed wide dismay with the measure, which includes only $12 billion in spending cuts along with $620 billion in tax increases on top earners.</p><p>Majority Leader Eric Cantor, the No. 2 Republican in the House, told reporters after huddling with other Republicans that he does not support the Senate's bill.</p><p>"The lack of spending cuts in the Senate bill was a universal concern amongst members in today's meeting. Conversations with members will continue throughout the afternoon on the path forward," said Cantor spokesman Rory Cooper.</p><p>Republicans returned for a second meeting at 5:15 p.m. EST (2215 GMT).</p><p>Republicans could face a backlash if they scuttle the deal. <title>Stalin's birthday marked in Russia and b</title>

<![CDATA[ TBILISI, Georgia (AP)  People across the vast territory where Josef Stalin once imposed his terror have marked the 133rd anniversary of the dictator's birth, some in hatred but others in reverence.<p></p><p>In Moscow, several hundred Russian Communists led by their leader Gennady Zuyganov laid flowers at Stalin's grave at the Red Square Friday, while smaller rallies were held across Russia and several former Soviet republics.</p><p>Leftists in neighboring Belarus said they found a Stalin statue that was buried after denunciation of his personality cult in 1956, but refused to specify its whereabouts because they fear authorities will order its destruction. Authorities in Stalin's hometown of Gori, Georgia, they will reinstall his statue that was removed in 2010.</p><p>In southern Ukraine, several ethnic Crimean Tatars trashed a small street exhibition on Stalin. The entire Crimean Tatar population of Ukraine was hastily deported in cattle trains on Stalin's orders in 1944 for their alleged collaboration with Nazi Germans during World War II. <title>Venezuela's Chavez &amp;quot;improves slight</title>

<![CDATA[ CARACAS (Reuters) - Venezuelan President Hugo Chavez's condition has "improved slightly" after a cancer operation in Cuba, the information minister said on Monday, amid doubts over whether the former soldier is in good enough health to continue governing.<p></p><p>"The patient has shown a slight improvement in his condition," Venezuelan Information Minister Ernesto Villegas said during a terse televised statement, adding the president has maintained contact with family members.</p><p>Chavez has not been heard from in two weeks following a fourth operation for an unspecified type of cancer in the pelvic region. The government has said he suffered post-operatory complications including unexpected bleeding and a lung infection, but offered few details about his actual condition.</p><p>His death, or even his resignation for health reasons, would upend the politics of the South American OPEC nation where his personalized brand of oil-financed socialism has made him a hero to the poor but a pariah to critics who call him a dictator.</p><p>His allies are now openly discussing the possibility that he may not be back in time to be sworn in for his third six-year term on the constitutionally mandated date of January 10.</p><p>Opposition leaders say a delay to his taking power would be another signal that Chavez is not in condition to govern and that fresh elections should be called to choose his replacement.</p><p>They believe they have a better shot against Chavez's anointed successor, Vice President Nicolas Maduro, than against the charismatic president who for 14 years has been nearly invincible at the ballot box.</p><p>But a constitutional dispute over succession could lead to a messy transition toward a post-Chavez era.</p><p>Maduro has become the government's main figurehead in the president's absence. His speeches have mimicked Chavez's bombastic style that mixes historical references with acid insults of adversaries.</p><p>Opposition leader Henrique Capriles, who lost to Chavez in the October presidential vote, slammed Maduro in an interview published on Sunday for failing to seek dialogue with the opposition at a time of political uncertainty.</p><p>"Maduro is not the one that won the elections, nor is he the leader," Capriles told the local El Universal newspaper. "Because Chavez is absent, this is precisely the time that (Maduro) needs help from people (in the opposition camp)."</p><p>Chavez has vastly expanded presidential powers and built a near-cult following among millions of poor Venezuelans, who love his feisty language and social welfare projects.</p><p>The opposition is smarting from this month's governors elections in which Chavez allies won 20 of 23 states. <title>Gene-altered mosquitoes could be used vs</title>

<![CDATA[ KEY WEST, Fla. (AP)  Mosquito control officials in the Florida Keys are waiting for the federal government to sign off on an experiment that would release hundreds of thousands of genetically modified mosquitoes to reduce the risk of dengue fever in the tourist town of Key West.<p></p><p>If approved by the Food and Drug Administration, it would be the first such experiment in the U.S. Some Key West residents worry, though, that not enough research has been done to determine the risks that releasing genetically modified mosquitoes might pose to the Keys' fragile ecosystem.</p><p>Officials are targeting the Aedes aegypti mosquitoes because they can spread dengue fever, a disease health officials thought had been eradicated in the U.S. until 93 cases originated in the Keys in 2009 and 2010.</p><p>The trial planned by mosquito control officials and the British company Oxitec would release non-biting male mosquitoes that have been genetically modified to pass along a birth defect that kill their progeny before reaching maturity. The idea is that they will mate with wild females and their children will die before reproducing. After a few generations, Key West's Aedes aegypti population would die off, reducing the dengue fever risk without using pesticides and at relatively a low cost, the proponents say. There is no vaccine for dengue fever.</p><p>"The science of it, I think, looks fine. It's straight from setting up experiments and collecting data," said Michael Doyle, pointing to research Oxitec has had published in peer-reviewed scientific journals. He inherited the project when he took the lead at the Florida Keys Mosquito Control District in mid-2011.</p><p>The district's website says the modified genes will disappear from the environment after the mosquitoes carrying it die, resulting in no permanent change to the wild mosquito population. The district also says that the mosquito species isn't native to the Keys, nor is it an integral food source for other animals.</p><p>Dengue fever is a viral disease that inflicts severe flu-like symptoms  the joint pain is so severe its nickname is "breakbone fever." It isn't fatal but victims are then susceptible at subsequent exposures to dengue hemorrhagic fever, which can be.</p><p>"It's very uncomfortable. You ache all over, you have a terrible fever," said Joel Biddle, a Key West resident whose dengue fever symptoms lasted more than a week in 2009.</p><p>Biddle is among those concerned about the Key West trial. He worries the modified genetic material will somehow be passed to humans or the ecosystem, and he wants more research done. He and other Key West residents also chafe at the fact that the project was in the works long before it was made public late last year.</p><p>Only female mosquitoes bite, so the modified genetic material wouldn't be passed on to humans, Mosquito control and Oxitec officials said. They also say they're being transparent about their data and the trial.</p><p>Real estate agent Mila de Mier has collected more than 117,700 signatures on a petition she posted on Change.org against the trial. Most come from outside the Keys, which de Mier says shows that tourists don't support the mosquito control district.</p><p>"We are dependent here on our tourists, and people from all over the country have been sending the message," de Mier said.</p><p>A University of Florida professor who studies mosquito control said Oxitec's technology works and evidence from the company's experiments elsewhere show it can control mosquito populations, but it's not clear whether its methods are as effective at controlling the risk of disease transmission. Phil Lounibos of the Florida Medical Entomology Laboratory also said it would take repeated releases of modified mosquitoes for the program to work, and the public outcry against genetically modified organisms, even when it's irrational, may be insurmountable.</p><p>"The public resistance and the need to reach some agreement between mosquito control and the public, I see that as a very significant issue, outside of the (operating) costs, since this is not just a one-time thing," Lounibos said.</p><p>The Aedes aegypti has shown resistance to pesticides used to control other species, and is the most difficult for the district to manage. Common in the Southeast and the Caribbean, it lurks in standing water around homes and businesses and can breed in containers as small as bottle caps.</p><p>District inspectors go door-to-door to remove the standing water where they breed, a time-consuming task.The district spends roughly $1 million a year to suppress Aedes aegypti, 10 to 15 percent of the agency's budget, Doyle said.</p><p>"Unfortunately, control of Aedes aegypti is a never-ending job," said Larry Hriber, the mosquito control district's research director.</p><p>In the trial, thousands of male mosquitoes bred by Oxitec would be released in a handful of Key West blocks where the Aedes aegypti is known to breed; the number of mosquitoes in those neighborhoods would be measured against the numbers from similar blocks where no modified mosquitoes were released.</p><p>The state's agriculture department oversees the mosquito control district, and Doyle said he would not expect any challenge from the state if the FDA signed off on the trial. The mosquito control district wouldn't need any local permit for the trial, either, but officials held a public meeting earlier this year and have posted information on the agency's website.</p><p>That trial may be years away. FDA spokeswoman Morgan Liscinsky said no genetically modified species can be released without approval.</p><p>There hasn't been a case of dengue fever in Key West since November 2010, but two other cases were reported elsewhere in South Florida this fall.</p><p>The mosquito trial proposed for Key West wouldn't be the first release of genetically modified insects in the U.S.</p><p>In 2009, the U.S. Department of Agriculture's Animal and Plant Health Inspection Service concluded that integrating genetically modified pink bollworms, bred by Oxitec to be sterile but more competitive in mating than regular bollworms, into the agency's plant pest control program was "the environmentally preferable alternative" to combat the cotton pest. The program was discontinued, however, after officials found that the genetically modified insects were not as hardy as pink bollworms sterilized through irradiation, and that their use in organic cotton fields would cause farmers to lose their certification.</p><p>Oxitec said the USDA's environmental assessment is one of several examples of proof that the trial's risks and methods are being independently evaluated. The company has trials in Brazil, the Cayman Islands and Malaysia, and it says it's gotten positive reviews from the latter two governments. It also cites its published research in peer-reviewed journals.</p><p>But Biddle, the onetime dengue patient, wants Oxitec to continue testing the modified mosquitoes outside the U.S.</p><p>"Why the rush here?" the Key West man said. "We already have test cases in the world where we can watch what is happening and make the best studies, because wouldn't it be wonderful if we could find out how it can be fail-safe  which it is not right now. <title>Pope visits jailed butler to grant pre-C</title>

<![CDATA[ VATICAN CITY (Reuters) - Pope Benedict made a surprise pre-Christmas visit to the jail holding his former butler on Saturday and pardoned him for stealing and leaking documents that alleged corruption in the Vatican.<p></p><p>The pope and Paolo Gabriele spent about 15 minutes together before Gabriele was freed and allowed to return to his wife and children in their Vatican apartment, Vatican spokesman Father Federico Lombardi said.</p><p>"What they said to each other will remain a secret between them ... he knows he made a mistake," Gabriele's lawyer Cristiana Arru, who was in the apartment when he returned home, told Reuters.</p><p>Gabriele was convicted of aggravated theft on October 6 in a case that shone unwelcome publicity on the Vatican. He had been serving an 18-month sentence in a jail cell in the city state's police headquarters.</p><p>Lombardi called the pope's action "a paternal gesture towards a person with whom the pope shared his daily life for several years ... this is a happy ending in this Christmas season to this sad and painful episode."</p><p>Both Lombardi and Arru described the encounter as "intense" because it was the first time the two had seen each other since last May, when Gabriele was arrested after Vatican police found many documents in his possession that had been stolen from the pope's office.</p><p>The pope also pardoned a Vatican computer expert who had received a suspended sentence in a separate trial.</p><p>VATILEAKS SAGA</p><p>In a saga that became known as "Vatileaks", Gabriele leaked documents showing what appeared to be a power struggle at the highest ranks of the Church, and internal conflict about how transparent the Vatican's scandal-plagued bank should be with outside financial authorities.</p><p>He told investigators he had acted because he saw "evil and corruption everywhere in the Church" and that information was being hidden from the pope.</p><p>The Vatican said Gabriele would no longer be able to work there but would be helped to find a job and start a new life outside its walls together with his family.</p><p>"When he came home, the kids jumped up and hung from his neck. It was a very tough time for them. I don't think the whole episode has sunk in for them yet," lawyer Arru said.</p><p>Gabriele, 46, said at his trial - one of the most sensational in the recent history of the Holy See - that he did not consider himself a thief and that he was motivated by "visceral" love for the Church.</p><p>The butler, who served the pope his meals and helped him dress, photocopied sensitive documents under the nose of his immediate superiors in a small office adjacent to the papal living quarters in the Apostolic Palace.</p><p>He then hid more than 1,000 copies and original documents, including some the pope had marked "to be destroyed", among many thousands of other papers and old newspaper clippings in a huge armoire in the family apartment inside the Vatican walls.</p><p>A former member of the small, select group known as "the papal family", Gabriele was one of fewer than 10 people who had a key to an elevator leading directly to the pope's apartments.</p><p>He said at the trial that from his perch as papal butler he was able to see how easily a powerful man could be manipulated by aides and kept in the dark about things he should have known.</p><p>The leaked papers revealed inner workings of an institution long renowned for its secrecy, and triggered one of the biggest crises of Pope Benedict's papacy when they emerged in a muckraking expose by an Italian journalist earlier this year.</p><p>The case was all the more embarrassing at a time when the Church was trying to limit the fallout from a series of scandals involving sexual abuse of minors by clerics around the world, as well as from mismanagement at its bank.</p><p>However, many people believe the butler could not have acted alone and was a fall-guy for others in the Vatican. <title>Patent agency rejects Apple &amp;quot;pinch-</title>

<![CDATA[ (Reuters) - U.S. patent authorities rejected Apple Inc's key "pinch-to-zoom" patent in an initial ruling, the second setback in less than two months for the iPhone maker in its patent battle with Samsung Electronics Co Ltd.<p></p><p> Apple's shares have taken a beating recently, with investors worried about rising competition from Samsung and other mobile device makers using Google Inc's Android platform.</p><p> Apple scored a sweeping legal victory over its South Korean competitor in August when a U.S. jury found Samsung had copied critical features of the hugely popular iPhone and iPad and awarded Apple $1.05 billion in damages.</p><p> Samsung and Apple, the world's top two smartphone makers, are locked in patent disputes in at least 10 countries as they vie to dominate the lucrative mobile market and win over customers with their latest gadgets.</p><p> The U.S. Patent and Trademark Office on Wednesday temporarily invalidated the "pinch-to-zoom" patent, which had been contested at the trial in August. The jury had ruled that Samsung had infringed six of seven Apple patents.</p><p> The "pinch-to-zoom" feature distinguishes between single-touch and multitouch gestures on a mobile device screen and allows the user to zoom in or out by moving two fingers apart or closer together while touching the display.</p><p> A U.S. judge denied on Monday Apple's request for a permanent injunction against Samsung's smartphones.</p><p> Samsung won a preliminary invalidation of Apple's "rubber-banding" patent in October that had the "bounce" feature. The patent allows a user with a touch screen to bounce back to the image on the screen if the user goes beyond the edge.</p><p> When the U.S. patent office rules against a patent, the full process involves multiple steps and can take years. <title>Vatican takes first spot in Internet dom</title>

<![CDATA[ PARIS (Reuters) - The Vatican has come out in first place in a long-awaited draw to expand the Internet address system with new domain names that go beyond the usual .com, .org or .net endings.<p></p><p>ICANN, the corporation that oversees the Internet address system, announced this week the domain name .catholic written in Chinese characters will be the first bid it considers in a drive to expand and reorganize sites on the World Wide Web.</p><p>The same extension in Arabic letters ranked 25th in the random draw and the Vatican's application for a version in Cyrillic for Russian and other Slavic languages came in 96th.</p><p>Ranking high means the applicant could get approval early next year to operate the new domain and approve addresses using it. In the Vatican's case, Rome could then ensure only genuine Roman Catholic institutions get to use that domain name.</p><p>"This is a way to give a coherence and authentication to our presence in the digital arena," said Monsignor Paul Tighe, secretary of the Pontifical Council for Social Communications.</p><p>"Anyone looking online will recognize the site belongs to an institution that belongs to the Catholic Church," he said, adding the new, so-called top level domain names (|TLDs) could also help speed online searches.</p><p>.BIBLE AND .ISLAM</p><p>For online retailers such as Amazon, whose application for .store in Japanese came in second, early approval could mean a competitive advantage and prompt a quick introduction of the new name.</p><p>But the Vatican did not enter the draw for commercial reasons and would not rush to launch its TLDs, Tighe said. In addition, the main TLD it seeks - .catholic in Latin letters - ended up in 1,366th place and may take months before it is approved.</p><p>Website owners are now restricted to a few dozen TLDs such as .com and country code domains such as .co.uk or .fr. Many of the 1,930 applications for new TLDs came from companies, including Internet giants such as Amazon and Google.</p><p>Several other faith-based groups applied for other TLDs such as .bible or .islam. The extension .mormon was the next-highest religious application drawn, coming in at 118th place.</p><p>ICANN (www.icann.org), the Internet Corporation for Assigned Names and Numbers, has stressed that assigning a certain TLD does not imply any endorsement of the religious group seeking it, just recognition it is the best suited to use the name.</p><p>Tighe said the ICANN draw handled applications for TLDs in non-Latin alphabets first, which explained why the Vatican's Chinese, Arabic and Cyrillic extensions came out far ahead of its main TLD in Latin letters.</p><p>INTERNET IMPRIMATUR</p><p>ICANN invited comments on applications earlier this year. The Vatican's application for exclusive use of .catholic drew criticism from members of several Protestant churches that also use the term, which comes from the Greek for "universal".</p><p>"This request is a move by a powerful group to squelch the voices and rights of other Christians," Dave Daubert, pastor of Zion Lutheran Church in Elgin, Illinois, wrote on the ICANN webpage for comments on the applications.</p><p>Saudi Arabia, the birthplace of Islam, apparently saw no hope of a consensus on religious TLDs and opposed them all.</p><p>Some religions seem to have kept out of the fray entirely.
